MEDICA CONGRESS / TECH FORUM: Patents: What
innovators in Medical Technology need to know
11:00-13:00 Uhr Messehalle 12
Chair and Ir. Thérèse Schölvinck, Director in Medical Technology, European
Moderator: Patent Offi ce, Rijswijk, NL
Academic research is more and more interacting with industrial partners and
technology transfer institutions, which have a strong interest in commercialising
their inventions and research results. At the same time, especially in academics,
there seems to be a considerable lack of information on how to use intellectual
property rights (IPR) to protect these results but also on how to make use of the
enormous information, published in patent applications. Consequently, the aim of
this presentation is to give researchers and business partners an insight into the
world of patents with an emphasis on the European patent system. First an
introduction to patents and practical information on the procedure to obtain a
patent will be provided. Moreover, topics related to the search of patent literature
will be presented, including an introduction to patent classifi cation systems as
well as an overview of public tools/databases for patent literature search and fi le
inspection. Finally, patent related issues for medical technologies and computer
implemented medical technology will be addressed.
11.00 - 11.45
If you invented it, protect it!
- What is an invention? What is a patent?
- The strongest form of IP: the pros and cons of patenting your invention
- The special case of medical technology - what you can patent
- ... and what is not patentable in Europe
Dr. Anja-Katrin Prechtel, EPO patent examiner in the fi eld of medical therapy,
EPO, Munich, D, and Ing. Germàn de la Hera, EPO patent examiner in fi eld of
medical diagnosis, EPO Rijswijk, NL
11.45 - 12.15
If they invented it, make sure you know about it!
- The price of ignoring other people's patents
- The upside (1): an incomparable knowledge resource
- The upside (2): it might look like a patent, but is it really in force? Looking for
opportunities to exploit technologies
- Know when you need to know
... about the technology described in patents
... about the legal status of a patent
- Getting started: free patent databases on the net
Dr. Roland Feinäugle, EPO expert on patent databases, EPO, Vienna, AU
