Under the <strong>OHS</strong> legislation in <strong>NSW</strong> employers must consult with employees on matters<br />
affecting their health and safety. As a taxi operator you have this duty to consult with those<br />
working for you.<br />
What should you consult with employees and bailee drivers about concerning <strong>OHS</strong>?<br />
You should consult about <strong>OHS</strong> related to the following:<br />
Changes to premises, work methods, work systems, plant or substances<br />
Risk assessment and review<br />
Risk monitoring procedures<br />
Facilities for employee welfare<br />
Purchasing<br />
Job design<br />
<strong>OHS</strong> incident reporting / investigation<br />
How can you consult with employees about <strong>OHS</strong>?<br />
There are three types of arrangements for consulting about <strong>OHS</strong>:<br />
<strong>OHS</strong> committees<br />
<strong>OHS</strong> representatives<br />
Other agreed arrangements<br />
Even if you only have one employee or bailee taxi driver you must allow for consultation<br />
about <strong>OHS</strong>. It is a legal requirement in <strong>NSW</strong>.<br />

<strong>Taxi</strong> <strong>Operators</strong><br />
WorkCover <strong>NSW</strong> has the right to audit your business for <strong>OHS</strong> procedures, particularly if a<br />
serious accident occurs. This may lead to court action and fines if you do not meet <strong>OHS</strong><br />
legal requirements.<br />
One of the things that the auditors look for are that the plans you have are put into action.<br />
It is not enough to have a plan in your filing cabinet if you are not using the plan.<br />
Therefore it is a good idea to keep written records of changes you have made to improve<br />
safety in the workplace.<br />
