How would you resolve a dispute about Fitness for Employment?
If a dispute should occur about fitness for employment you should take the following steps
to help resolve the dispute:
Step 1:
Make sure that workplace assessment has been conducted and a suitable Return To Work
plan has been developed
Step 2:
Make sure that you or the rehabilitation provider has consulted with the doctor and worker
about the workplace assessment and the Return To Work plan.
Step 3:
If necessary, refer to Injury Management Consultant to help reach a Return To Work
agreement.
Step 4:
If doctor does not keep to the Return To Work agreement, have it reviewed by the Injury
Management Consultant.
Step 5:
If agreement is still not reached:
All parties agree on assessment by Approved Medical Specialist
OR
Refer to Workers Compensation Commission for assessment by Approved Medical
Specialist
Step 6:
Parties to the dispute act in accordance with Approved Medical Specialist outcome.
The key message is to communicate, cooperate, conciliate and so help prevent disputes
happening in the first place.
