Justice Stevens said:<br />

“The Chief Justice is unable to be present for this session, but will<br />

participate in the consideration and decision of the cases on the basis<br />

of the briefs and the transcripts of the oral arguments.<br />

“Today’s orders of the <strong>Court</strong> have been duly entered and certified,<br />

and filed with the Clerk, and they will not be otherwise announced.”<br />

Certiorari—Summary Disposition<br />

No. 02–121. Joseph Klauser, Warden v. William L. Gray. On petition<br />

for writ of certiorari to the United States <strong>Court</strong> of Appeals for the<br />

Ninth Circuit. Petition for writ of certiorari granted. Judgment vacated,<br />

and case remanded to the United States <strong>Court</strong> of Appeals for<br />

the Ninth Circuit for further consideration in light of Early v. Packer,<br />

537 U. S. ––– (<strong>2002</strong>).<br />

No. 02–5161. Luis Torres-Soria, Petitioner v. United States. On petition<br />

for writ of certiorari to the United States <strong>Court</strong> of Appeals for<br />

the Fifth Circuit. Motion of petitioner for leave to proceed in forma<br />

pauperis and petition for writ of certiorari granted. Judgment vacated,<br />

and case remanded to the United States <strong>Court</strong> of Appeals for the Fifth<br />

Circuit for further consideration in light of Alabama v. Shelton, 535<br />

U. S. 654 (<strong>2002</strong>).<br />
