the consideration and decision of today’s cases on the basis of the briefs
and transcripts of oral argument.”

No. 01–1420. Washington State Department of Social and Health
Services, et al., Petitioners v. Guardianship Estate of Danny Keffeler,
et al. On writ of certiorari to the Supreme Court of Washington. Judgment
reversed, and case remanded to the Supreme Court of Washington
for further proceedings not inconsistent with the opinion of this
Court. Opinion by Justice Souter.
No. 01–7662. Thomas Joe Miller-El, Petitioner v. Janie Cockrell, Director,
Texas Department of Criminal Justice, Institutional Division.
On writ of certiorari to the United States Court of Appeals for the
Fifth Circuit. Judgment reversed, and case remanded to the United
States Court of Appeals for the Fifth Circuit for further proceedings in
conformity with the opinion of this Court. Opinion by Justice Kennedy.
