Former Khmer Rouge troops need to be<br />

educated about <strong>the</strong> Draft Law on <strong>the</strong> Establishment<br />

<strong>of</strong> Extra-Ordinary Chambers in <strong>the</strong> Courts <strong>of</strong><br />

<strong>Cambodia</strong> <strong>for</strong> Prosecuting Crimes Committed during<br />

<strong>the</strong> Period <strong>of</strong> Democratic Kampuchea (<strong>the</strong> Khmer<br />

Rouge law) and <strong>the</strong> process <strong>of</strong> <strong>the</strong> upcoming mixed<br />

tribunal. At <strong>the</strong> same time, <strong>the</strong>y <strong>of</strong> course have <strong>the</strong><br />

right to express <strong>the</strong>ir opinions regarding <strong>the</strong> tribunal,<br />

including <strong>the</strong> question <strong>of</strong> protecting one <strong>of</strong> <strong>the</strong>ir<br />

leaders, Ieng Sary. It is a free country now, I would<br />

tell <strong>the</strong>m.<br />

But <strong>the</strong> secretary-general <strong>of</strong> <strong>the</strong> Democratic<br />

National Movement (DNUM), Long Norin, is<br />

confused about what <strong>the</strong> current peace in <strong>Cambodia</strong><br />

is all about. Peace to him and to <strong>the</strong> o<strong>the</strong>r Khmer<br />

Rouge hardliners means no more executions <strong>of</strong><br />

Angkar’s enemies. We - who were once <strong>the</strong> victims<br />

<strong>of</strong> Angkar - have no enemies. We never regarded<br />

ei<strong>the</strong>r <strong>the</strong> <strong>for</strong>mer Khmer Rouge troops or <strong>the</strong> Khmer<br />

Rouge leaders as our enemies. The Khmer Rouge<br />

have been living among us <strong>for</strong> over thirty years. We<br />

have tolerated <strong>the</strong>m and do not seek vengeance or<br />

<strong>the</strong>ir deaths; we will let <strong>the</strong> law judge <strong>the</strong>ir acts. The<br />

upcoming tribunal does not even allow <strong>for</strong> <strong>the</strong> death<br />

penalty.<br />

Make no mistake: <strong>the</strong> DNUM is a Khmer<br />

Rouge political movement, modernized by Ieng Sary.<br />

He led 3,000 troops out <strong>of</strong> <strong>the</strong> jungles, not in order to<br />

join <strong>the</strong> Royal Government <strong>of</strong> <strong>Cambodia</strong>, but ra<strong>the</strong>r<br />

to sustain his power as a Khmer Rouge leader. Even<br />

though <strong>the</strong> defections <strong>of</strong> <strong>the</strong>se troops led to <strong>the</strong><br />

<strong>of</strong>ficial end <strong>of</strong> <strong>the</strong> civil war in 1998, and supposedly<br />

<strong>the</strong> end <strong>of</strong> <strong>the</strong> Khmer Rouge, in reality <strong>the</strong> DNUM<br />

continues to seek a role in <strong>Cambodia</strong>n society <strong>for</strong><br />

Khmer Rouge leaders.<br />

PROSECUTING IENG SARY<br />

Ieng Sary knows that he cannot escape trial <strong>for</strong><br />

<strong>the</strong> deaths <strong>of</strong> more than one million people. He also<br />

knows that in <strong>the</strong> eyes <strong>of</strong> many <strong>Cambodia</strong>ns, <strong>the</strong><br />

amnesty from <strong>the</strong> King will not protect him from<br />

being tried at <strong>the</strong> upcoming tribunal. But he<br />

continues to fool <strong>the</strong> <strong>for</strong>mer Khmer Rouge troops,<br />

even to <strong>the</strong> extent <strong>of</strong> blocking <strong>the</strong> effective<br />

reintegration <strong>of</strong> <strong>the</strong>se cadres and <strong>the</strong>ir families into<br />

society.<br />

<strong>Cambodia</strong> must prosecute Ieng Sary. In fact, in doing<br />

so, <strong>Cambodia</strong> will honor <strong>the</strong> King’s wishes, because<br />

His Majesty signed <strong>the</strong> Khmer Rouge tribunal law,<br />

which is intended to prosecute <strong>the</strong> Khmer Rouge<br />

leaders, including Ieng Sary. The law does not<br />

stipulate that those who have already received<br />

amnesty should be left <strong>of</strong>f <strong>the</strong> list <strong>of</strong> potential<br />

defendants. In fact, in earlier negotiations, <strong>the</strong> UN<br />

made it clear that such amnesties are unacceptable. If<br />

Ieng Sary’s amnesty stands, <strong>the</strong> UN will not<br />

cooperate. Ieng Sary knows this and DNUM knows<br />

this.<br />

DNUM spokesman Suong Sikoeun himself is a<br />

life-long supporter <strong>of</strong> <strong>the</strong> Khmer Rouge movement,<br />

and thus was part <strong>of</strong> <strong>the</strong> Khmer Rouge conspiracy.<br />

He should be aware that according to <strong>the</strong> Genocide<br />

Convention, conspiracy to commit genocide is a<br />

crime (see Article 4 <strong>of</strong> <strong>the</strong> Khmer Rouge law). It is<br />

clear that Ieng Sary bears not only moral<br />

responsibility, but must also be prepared to let <strong>the</strong><br />

court judge his legal responsibility <strong>for</strong> <strong>the</strong> deaths <strong>of</strong><br />

more than one million people in <strong>Cambodia</strong>. To resist<br />

<strong>the</strong> <strong>Cambodia</strong>n court is <strong>the</strong> same as attempting to<br />

destabilize <strong>Cambodia</strong>, and those committing such<br />

acts should, perhaps, also be judged by <strong>the</strong> court.<br />
