EPA Advice/Comment - 6<br />

Where Minimum Acceptable <strong>Management</strong> Practices (MAMP’s) are not adopted through<br />

voluntary take-up within 3 years of the development of an integrated catchment<br />

management plan, regulations should be introduced through the Environmental<br />

Protection Act to enable coercive action to be taken to achieve the level of conformance<br />

in catchment behaviour that is required to protect the environment.<br />

EPA Advice/Comment - 7<br />

Effective Natural Resource <strong>Management</strong> legislation should be passed to:<br />

• enable proper coordination of NRM activities to occur at all levels;<br />

• establish a biding “duty of care” on all l<strong>and</strong> users;<br />

• to facilitate the formation <strong>and</strong> use of government, community <strong>and</strong> industry<br />

partnerships for NRM; <strong>and</strong><br />

• establish mechanisms for assigning accountabilities for actions;<br />

with the goal of achieving environmentally acceptable development on rural l<strong>and</strong>.<br />

EPA Advice/Comment - 8<br />

The EPA will liaise with the proponents with a view to the proponents submitting a<br />

request under S46 of the Environmental Protection Act for the Environmental Conditions<br />

to be amended, <strong>and</strong> proposing the nature of those amendments.<br />

EPA Advice/Comment - 9<br />

In any review of the Environmental Conditions, consideration will need to be given to the<br />

procedures which may be required to set down the Minister’s expectations of nonproponent<br />

management agencies.<br />

12.2 General<br />

• The work of the <strong>Peel</strong>-<strong>Harvey</strong> Expert Review Committee has been carried out in a<br />

competent <strong>and</strong> thorough manner by people who are experts in management of<br />

environmental systems <strong>and</strong> natural resource <strong>and</strong> catchment management.<br />

• The EPA accepts <strong>and</strong> endorses the advice <strong>and</strong> recommendations provided to it by<br />

the <strong>Peel</strong>-<strong>Harvey</strong> Expert Review Committee (although not necessarily their precise<br />

wording).<br />

• The proponents for the <strong>Peel</strong>-<strong>Harvey</strong> <strong>System</strong> <strong>Management</strong> <strong>Strategy</strong> have not fully<br />

complied with the environmental conditions set on the project by the Minister for<br />

Environment.<br />
