CHAPTER 1 – INTRODUCTION & PLANNING POLICY CONTEXT<br />

What is a conservation area?<br />

<strong>Denham</strong> <strong>Conservation</strong> <strong>Area</strong><br />

Local plann<strong>in</strong>g authorities have a statutory duty to designate as conservation<br />

areas any “areas of special architectural or historic <strong>in</strong>terest the character or<br />

appearance of which it is desirable to preserve or enhance” (section 69 of the<br />

Plann<strong>in</strong>g (Listed Build<strong>in</strong>gs and <strong>Conservation</strong> <strong>Area</strong>s) Act 1990).<br />

Effect of designation<br />

<strong>Conservation</strong>-area designation imposes additional controls over demolition,<br />

m<strong>in</strong>or development and a measure of protection for trees. The Council has<br />

produced a leaflet “Guidance for Residents” which is reproduced <strong>in</strong> the<br />

Appendix. In exercis<strong>in</strong>g their plann<strong>in</strong>g powers, local plann<strong>in</strong>g authorities must<br />

pay special attention to the desirability of preserv<strong>in</strong>g or enhanc<strong>in</strong>g the<br />

character or appearance of conservation areas.<br />

Plann<strong>in</strong>g <strong>in</strong> South Bucks<br />

The Council’s current policies relat<strong>in</strong>g to conservation areas are conta<strong>in</strong>ed <strong>in</strong><br />

the South Bucks District Local Plan which was adopted <strong>in</strong> March 1999. As the<br />

new Local Development Framework emerges the Local Plan policies will<br />

gradually be replaced by Development Plan Documents. <strong>Conservation</strong> <strong>Area</strong><br />

appraisals will not become Supplementary Plann<strong>in</strong>g Documents but their<br />

provisions will be a “material consideration” when the Council is exercis<strong>in</strong>g its<br />

functions as the local plann<strong>in</strong>g authority.<br />

Archaeology and plann<strong>in</strong>g<br />

Archaeological <strong>in</strong>formation is held on the County Sites and Monuments Record<br />

and regularly updated. The effect of development on archaeological rema<strong>in</strong>s<br />

is a material plann<strong>in</strong>g consideration. Applicants for plann<strong>in</strong>g consent may be<br />

required to undertake field evaluations to <strong>in</strong>form decisions and/or conditions<br />

may be applied to safeguard archaeological <strong>in</strong>terests. For further <strong>in</strong>formation<br />

Background to the designation<br />

<strong>Denham</strong> <strong>Conservation</strong> <strong>Area</strong> was first designated <strong>in</strong> 1971. As part of its<br />

programme to review all its conservation areas, hav<strong>in</strong>g taken <strong>in</strong>to account<br />

changes with<strong>in</strong> the area as well as current legislation and guidance on<br />

conservation areas, South Bucks District Council formulated proposals for<br />

amendments to the boundaries of the <strong>Denham</strong> <strong>Conservation</strong> <strong>Area</strong>. Local<br />

residents were consulted on these proposals and <strong>in</strong>vited to submit their<br />

comments by way of a questionnaire. Additional <strong>in</strong>formation on the proposals<br />

was provided by way of an exhibition <strong>in</strong> the <strong>Denham</strong> Parish Office dur<strong>in</strong>g<br />

December 2005. Follow<strong>in</strong>g a largely positive response to the consultation the<br />

<strong>Conservation</strong> <strong>Area</strong> was re-designated with amended boundaries on 31st March<br />

2006.<br />
