CARDINAL CULLEN Section 42/1
File IX: Letters of Card. Cullen to Mgr. Kirby, 1873
No. Date (1873) Main Topics
1 5 Jan. O'Keeffe to sue +Moran for damages for slander and
defamation. The ease against Card. Cullen begins soon. O'Keeffe
holds that the Pope has no legal authority in these kingdoms.
2 7 Jan. Necessary to determine when laymen can go to law with
priests.
Dr. Forde has successfully undergone an operation.
3 12 Jan. (Abstract of Italian letter) Mgr. Forde is in
extremis.
O'Keeffe impugnes Cullen's authority as Apostolic Delegate. The Roman
witnesses should be able to prove this. Judge Whiteside favours O'Keeffe, but
there will probably be some Catholic jurors.
4 15 Jan. (Abstract of Italian letter) The Roman replies to Card.
Cullen's queries may come too late.
Mgr. Forde has died, and is a great loss to Dublin and to Ireland. He
would have been an invaluable witness at the trial.
5 15 Jan. The Roman witnesses should be able to show that Card.
Cullen had every necessary power in Fr.O'Keeffe’s case.
6 19 Jan. Trial delayed. Mr. Butt has declined to defend O 'K.
Pastoral letter drawn up for Bishops' meeting.
7 21 Jan. Successful meeting of Bishops. Pastoral adopted
(written by +Conroy), dealing with the Pope; persecution in Italy, Germany
and Switzerland; education; consecration of Ireland to the Sacred Heart.
Also a letter to the Pope and one to the German Bishops Irish Bishops wish
to hold another National Council.
8 24 Jan. The arguments re Fr. O'Keeffe's "demurrers" against
Card. Cullen's pleas are still going on - and going badly for O'Keeffe.
9 26 Jan. Sending letter to the Pope without +Moriarty's signature. (He was absent and
would not
sign without seeing the document).
Irish Bishops giving Mgr. Kirby full powers to act for
them re sale of vineyard.
O'Keeffe seems to have prejudiced his case by some
absurd theories.
While Judge Whiteside is for O ' K . , there are also three
Catholic judges.
10 27 Jan. Card. Cullen requests some books on Canon Law.
Trials of +Duggan and sixteen priests may be held before Card. Cullen's.
11 5 Feb. Card. Cullen has been ill. Trial postponed again;
perhaps until May.
Answers to queries have come from Card. Barnabo; not
12 after 13 satisfactory. ( text missing)
