The Phytosanitary Certificate is not necessary for import of manufactured or semimanufactured articles, other than plants and plant products, which present no risk of carrying pests. Such articles shall be examined by the inspectors and if an adverse condition is not observed, their entrance into Turkey is permitted. A Phytosanitary Certificate is not necessary for flower bouquets and garlands for noncommercial purposes. Nevertheless, these are inspected at the point of entry. If pests are identified, they are technically cleaned to render them free from pests, provided that the expense is met by the person concerned; bouquets and garlands which cannot be cleaned are destroyed. Plants intended for consumption, brought by and accompanying those who own land in another country and who travel with a special permit are inspected; plants which are determined to be clean are permitted to enter; otherwise they are destroyed. Application for a Plant Import Permit Article 15 – To import plants for planting , application is made with the “Plant Importation Permit Application Form”, an example of which is given in Annex VIII of this Regulation and a “Plant Importation Permit” in compliance with the example given in Annex VII of this Regulation by the Ministry or the related Directorate. Control at the Point of Entry Article 16 – As a result of the phytosanitary inspections done by the inspectors at the customs point of entry, import of plants which do not carry pests that are subject to phytosanitary measures is permitted. If deemed necessary, laboratory tests are made. Laboratory tests on imported material are conducted according to their properties by the Plant Quarantine Directorates, Provincial Control Laboratory Directorates of the Ministry, Plant Protection Research Institutes or other Research Institutes appointed by the Ministry. As a result of the controls, if the plants or plant products for import do not comply with the provisions of this Regulation, they are destroyed or returned to the sender. Within 2 days following a decision to return, the official phytosanitary service of the exporting country is informed by the return form given in Annex IX of this Regulation. Plants not Covered by the Regulation Article 17 – Importation of new plants that are not covered by this regulation is permitted under the control of the research institutes concerned, on condition that a permit is granted by the Ministry prior to importation. Principles for Free Zones Article 18 – On export from any region of Turkey to free zones, on export of plants and plant products to Turkey or other countries from these free zones, or on import of plants and plant products to these free zones and in transit passage through these free zones, the provisions of this Regulation are implemented in Free Zone Directorates. 8
Abrogated Regulations Article 19 – The following Regulations are abolished, together with all their annexes and amendments: a. Regulation on Kind and Quantity of Plants Brought by and Accompanying Passengers in accordance with Article 13 of the Agricultural Quarantine Regulation on Implementation of the Provisions of the Agricultural Quarantine Law, No 6968, published in the Official Gazette, No 11985, dated 28/4/1965. b. Regulation on Agricultural Quarantine, published in the Official Gazette, No 20808, dated 8/3/1991. Enforcement Article 20 – This Regulation enters into force after six months from its date of publication. Execution Article 21 – The provisions of this Regulation are executed by the Minister of Agriculture and Rural Affairs. 9
