3r. Chalfant presented a nap of that portion of Royce Area 364<br />

claimed by the Salish tribes (Def. Ex. 67) cogezher with acetate overlays,<br />

oce of which was Defendant's Exhibit No. 67-G on which he outlined the<br />

territory which he considered was used and occupied by the Wenatchee<br />

and the Columbia tribes. He also located permanenr village sites,<br />

temporary village sites, and early historical village sites. With respect<br />

to the territories which ke outlinzd C5alfast testified that "I have not<br />

intended to represent a boundary in the s29se of territorial own2rship<br />

that would imply exclusive ownership, that is, exclusive use and occupancy,<br />

on the part of the resident group; rather, these lines represent the<br />

maximum area for which there is total agreernect in the framework of the<br />

anthropological and historical literature on thzse people for the area<br />

that the aboriginal Columbia on the one hand and the aboriginal Wenatchee<br />

on the other hand occupied and ctilized." (Tr. 5&8) Chalfant did not<br />

include areas for either the Chelan or Entiat for the reason that he did<br />

not believe that they were parties to the Yakima Treaty. However, he<br />

testified that the land used by both of those tribes was to the north<br />

with the Entiat using and occupying the territory within the Entiat River<br />

drainage and the Chelan using and occupying the territory within the<br />

Chelan drainage system.<br />

The Wenatchee area of occupation includes the drainage system of .<br />

the Wenatchee River, extending to the west to the Cascade Mountain range,<br />

to the north to the range line becween the Entiat and Wenatchee River,.<br />

to the south to the Wenatchee mountain range dividing the drainage of<br />

the Wenatchee River from the upper Yakima River, and to the east to the
