(g) The contractor shall ensure regular and effective supervision of the personnel deployed by him. (h) The personnel deployed by him must be in the muster roll of the contractor. (i) The personnel to be deputed by the contractor shall observe all security , safety, fire rules of GAIL while at site. This work will be supervised by the supervisor of contractor. The contractor has to strictly adhere to guidance, instruction of EIC from time to time. (j) Contractor shall provide proper identification card for his personnel to be deputed by him for work duly signed by him or his authorized representative. Also the contractor has to obtain entry passes from CISF through EIC for his employees. (k) All personnel proposed to be deployed by the contractor shall be medically examined by qualified medical practitioner and it should be ensured that no person engaged by the contractor is suffering from communicable disease. (l) While confirming any of these conditions the contractor should ensure that no law of state regarding Labour their welfare conduct etc. are violated. The contractor shall indemnify by GAIL for any action brought against him for violation, non-compliance of any of the act rules & regulations of central / State or Local statutory authorities. (m) The contractor shall have to essentially take workmen compensation Insurance coverage for his workers. (n) No worker of the contractor (including the contractor) is permitted to consume alcoholic drinks, narcotics within GAIL premises. In case any worker / any person of the contactor is found under the influence of the above, the contractor shall change / replace the concerned person immediately failing which GAIL may terminate the said contract. (o) The contractor shall deploy the workers after due verification of their character and antecedents. In case any worker is found having criminal record, he shall have to be replaced forthwith without assigning any reason under as intimation to EIC concerned. (p) The contractor/contracting firm shall be required to obtain labour license from Assistant Labour Commissioner (Central), Kanpur if he engages 20 or more workmen/labours. 24
30. PHOTO GATE PASS/LABOUR PERMISSION/VEHICLE PERMISSION: The contractor shall arrange to make photo gate passes / labour permissions / vehicle passes etc. for his persons / labour / vehicles for working at site at his own cost and as per rules of the company. 31. TERMS OF PAYMENT: (A) PAYMENT OF RUNNING BILLS: 90% of work done shall be paid in R.A. bills and balance 10% shall be paid along with final bill. (B) PAYMENT OF FINAL BILL: (i) Contractor must submit his final bill within sixty days of completion of the work and payment of the final bill shall be made to the contractor within 120 days of the submission of the bill and after completion of all obligations under the contract. (ii) No Demand Certificate: The contractor shall submit No Demand Certificate (NDC) for the net payment as finalized in the final bill before release of payment. The final bill shall be paid only on submission of NDC, otherwise final bill will be paid only after one year of submission of the same, as per GAIL’s records and no claim of contractor shall be entertained thereafter. (C) All the payments shall be released through electronic mode (e-banking) from ICICI Bank/ HDFC Bank/ SBI and accordingly contractor shall provide details of their bank account no. and other bank details in the enclosed format(Refer Annexure) to which payment shall be released electronically. (D) The bills shall be submitted in a printed form in quadruplicate along with soft copy of bill. Security deposit (as per clause No. 12.0 of SCC) and other taxes as applicable shall be deducted from the bills. Payment of running bills shall be made to the contractor within 30 days of the submission of the bill to Engineer-In Charge. 32. CONSTRUCTION WATER AND POWER:- The Contractor shall make his own arrangement for water and power at his own cost. 33. In case of any accident, injury, death caused to the any employee of contractor while executing the work under the contract, the contractor shall 25
