solely be responsible to pay the adequate compensation, insurance money
etc. to the next kith & kin of that injury or dead taken. The contractor
undertakes and Indemnify owner from such liabilities.
34. The contractor also undertakes to obtain insurance cover policies covering
all risks which may arise out of the execution of work under the contract.
The contractor will pay the insurance premium to the insurance company
from time to time against the insurance cover policy taken for his employees
including third party.
35. In case of any disputes which may arise out of the any meaning,
interpretation of any term and condition of contract, the same shall be
referred to sole Arbitrator i.e. OIC of Pata or its nominee. The decision of
Sole Arbitrator shall be final & binding on both the parties to the contract i.e.
contractor & Owner. The Arbitration proceedings shall be governed under the
Indian Arbitration & Conciliation Act, 1996 and venue of Arbitration
proceedings shall be at Pata.
36. In case of court case, the contractor here agrees that the court of agreeing
shall only have the Jurisdiction to entertain such matter.
37. The contractor shall not engage or deploy any person having a criminal
record. If at any stage found, such person is executing the work, by order will
terminate the contract or advise the contractor to change that Labour.
38. TAXES, DUTIES, OCTROI ETC:
38.1 The CONTRACTOR agrees to and does hereby accept full and exclusive
liability for the payment of any and all Taxes, Duties, including Excise duty,
octroi etc. now or hereafter imposed, increased, modified, all the sales taxes,
duties, octrois etc. now in force and hereafter increased, imposed or
modified, from time to time in respect of WORKS and materials and all
contributions and taxes for unemployment compensation, insurance and old
age pensions or annuities now or hereafter imposed by any Central or State
Government authorities which are imposed with respect to or covered by the
wages, salaries, or other compensations paid to the persons employed by the
CONTRACTOR and the CONTRACTOR shall be responsible for the compliance
of all SUB-CONTRACTORS, with all applicable Central, State, Municipal and
local law and regulation and requirement of any Central, State or local
Government agency or authority. CONTRACTOR further agrees to defend,
indemnify and hold EMPLOYER harmless from any liability or penalty which
may be imposed by the Central, State or Local authorities by reason or any
violation by CONTRACTOR or SUB-CONTRACTOR of such laws, suits or
proceedings that may be brought against the EMPLOYER arising under,
