7.2 Right-to-Use; Multiple Dedicated Spaces<br />
7.2.1 In accordance with this Appendix, AT&T-13STATE grants to the Wireless Collocator the right to<br />
use a Dedicated Space. Each Dedicated Space within an Eligible Structure will be considered a<br />
single Dedicated Space for the application of rates according to this Appendix.<br />
7.3 Trouble Status Reports<br />
7.3.1 AT&T-13STATE and the Wireless Collocator are responsible for making best efforts to provide<br />
prompt verbal notification to each other of significant outages or operations problems which could<br />
impact or degrade AT&T-13STATE or the Wireless Collocator’s network, switches or services, with<br />
an estimated clearing time to restore service. In addition, AT&T-13STATE and the Wireless<br />
Collocator will provide written notification within twenty-four (24) hours to each other. When trouble<br />
has been identified, AT&T-13STATE or the Wireless Collocator is responsible for providing trouble<br />
status reports, consistent with this Appendix, when requested by AT&T-13STATE or the Wireless<br />
Collocator.<br />
7.4 Service Coordination<br />
7.4.1 AT&T-13STATE is responsible for coordinating with the Wireless Collocator to ensure that<br />
services are installed in accordance with the service request.<br />
7.5 Active/Inactive Space Determination<br />
7.5.1 In its notification regarding whether its request for collocation has been granted or denied AT&T-<br />
13STATE shall inform the Wireless Collocator if the space available for the requested collocation<br />
space will be Active Collocation or Inactive Space, as those terms are defined in Section 2 of this<br />
Appendix. If the Wireless Collocator’s space is placed in Inactive Space, then the notification shall<br />
also include rationale for placing the requested space in such category, including all power,<br />
switching, and other factors used in making the determination.<br />
7.5.2 In the event that the Wireless Collocator disputes the AT&T-13STATE placement of the space into<br />
Inactive Space, then the Wireless Collocator may request a tour of the Eligible Structure to verify<br />
the Active/Inactive space availability. AT&T-13STATE will provide all relevant documentation to<br />
the Wireless Collocator agent supporting its placement of Wireless Collocator’s requested<br />
collocation arrangement in Inactive Space, subject to executing a non-disclosure agreement at the<br />
time of the inspection tour. The request shall be submitted to the AT&T-13STATE-designated<br />
representative in writing within five (5) business days of notification to Wireless Collocator. If the<br />
Wireless Collocator fails to submit the written request within the eligible time frame, the option for<br />
an inspection tour is forfeited. The inspection tour will be scheduled within three (3) business days<br />
of receipt of the request for a tour. Any requested tour shall be scheduled to take place no later<br />
than seven (7) business days following the request for the inspection tour. At the Wireless<br />
Collocator’s request, the request for inspection tour for determination of Active/Inactive space may<br />
be conducted concurrently with a tour involving space availability disputes, as provided in this<br />
Appendix, thereby modifying the time frame requirements in this paragraph.<br />
7.5.3 The AT&T-13STATE representative will escort one (1) Wireless Collocator agent on the inspection<br />
tour. If the Wireless Collocator agent believes, based on the inspection tour of the Eligible<br />
Structure that the placement of the collocation space in Inactive Space is unsupportable, the<br />
Wireless Collocator agent shall promptly advise AT&T-13STATE orally and in writing within five (5)<br />
business days of the completion of the inspection tour. The Wireless Collocator may dispute the<br />
AT&T-13STATE findings through the Dispute Resolution Process outlined herein, and the burden<br />
of proof shall be on AT&T-13STATE to justify the basis for placement of the Wireless Collocator’s<br />
space in Inactive Space. If the Wireless Collocator fails to submit the written request within the<br />
eligible time frame, it will be assumed that no dispute exists.
