1.2 Context of <strong>the</strong> Commission’s Establishment<br />

In 2005 and 2006 South Africa was rocked by a political crisis <strong>in</strong>volv<strong>in</strong>g <strong>the</strong><br />

National Intelligence Agency (NIA). Indications of possible misconduct<br />

emerged when a prom<strong>in</strong>ent bus<strong>in</strong>essman and political figure compla<strong>in</strong>ed <strong>to</strong><br />

M<strong>in</strong>ister Kasrils that he was under surveillance by NIA. The M<strong>in</strong>ister<br />

requested <strong>the</strong> Inspec<strong>to</strong>r-General of Intelligence <strong>to</strong> <strong>in</strong>vestigate <strong>the</strong> matter. The<br />

Inspec<strong>to</strong>r-General found, among o<strong>the</strong>r th<strong>in</strong>gs, that NIA had conducted illegal<br />

surveillance for political reasons and that <strong>the</strong> Direc<strong>to</strong>r-General of NIA had<br />

unlawfully ordered <strong>the</strong> <strong>in</strong>terception of <strong>the</strong> communication of rul<strong>in</strong>g party and<br />

opposition politicians, some of whom were members of Parliament. 2 The<br />

Direc<strong>to</strong>r-General and two o<strong>the</strong>r officials were suspended and <strong>the</strong>reafter<br />

dismissed. These dramatic events provoked considerable consternation<br />

among political parties and members of <strong>the</strong> public.<br />

The crisis led <strong>to</strong> <strong>the</strong> M<strong>in</strong>ister’s decision <strong>to</strong> set up <strong>the</strong> Commission. Speak<strong>in</strong>g<br />

at <strong>the</strong> launch of <strong>the</strong> Commission, M<strong>in</strong>ister Kasrils made <strong>the</strong> follow<strong>in</strong>g remarks:<br />

I <strong>in</strong>dicated <strong>in</strong> my Budget Vote speech that it was necessary <strong>to</strong> use<br />

this lamentable episode at NIA <strong>to</strong> undertake fundamental reforms<br />

aimed at prevent<strong>in</strong>g such abuses <strong>in</strong> <strong>the</strong> future. To do so, we need<br />

<strong>to</strong> review legislation and streng<strong>the</strong>n regulations, operational<br />

procedures and control measures where necessary. I also po<strong>in</strong>ted<br />

out <strong>the</strong> need <strong>to</strong> attend <strong>to</strong> <strong>the</strong> perfidious mentality that enabled <strong>the</strong>se<br />

dirty tricks <strong>to</strong> take place and most importantly, that such reforms be<br />

placed <strong>in</strong> <strong>the</strong> public doma<strong>in</strong> so as <strong>to</strong> rebuild public confidence and<br />

trust. 3<br />
