undertake covert operations aimed at counter<strong>in</strong>g threats <strong>to</strong> national security;<br />

and <strong>to</strong> operate with a high level of secrecy.<br />

Politicians and <strong><strong>in</strong>telligence</strong> officers are able <strong>to</strong> abuse <strong>the</strong>se powers <strong>to</strong> <strong>in</strong>fr<strong>in</strong>ge<br />

civil liberties, <strong>in</strong>terfere <strong>in</strong> lawful political activities and favour or prejudice a<br />

political party or leader, <strong>the</strong>reby compromis<strong>in</strong>g <strong>the</strong> <strong>in</strong>tegrity of <strong>the</strong> democratic<br />

process. They can <strong>in</strong>timidate <strong>the</strong> opponents of government, create a climate<br />

of fear and fabricate or manipulate <strong><strong>in</strong>telligence</strong> <strong>in</strong> order <strong>to</strong> <strong>in</strong>fluence<br />

government decision-mak<strong>in</strong>g and public op<strong>in</strong>ion. They are also able <strong>to</strong> abuse<br />

<strong><strong>in</strong>telligence</strong> funds and methods for personal ga<strong>in</strong> and <strong>to</strong> promote private<br />

commercial <strong>in</strong>terests.<br />

Given <strong>the</strong>se dangers, democracies are confronted by <strong>the</strong> challenge of<br />

construct<strong>in</strong>g rules, controls and o<strong>the</strong>r safeguards that protect rights and<br />

freedoms and prevent misconduct by <strong>the</strong> <strong><strong>in</strong>telligence</strong> services but do not<br />

restrict <strong>the</strong> services <strong>to</strong> such an extent that <strong>the</strong>y are unable <strong>to</strong> fulfil <strong>the</strong>ir<br />

responsibilities. In short, <strong>the</strong> challenge is <strong>to</strong> ensure that <strong>the</strong> <strong><strong>in</strong>telligence</strong><br />

agencies pursue a legitimate mandate <strong>in</strong> a legitimate manner and <strong>in</strong> <strong>the</strong><br />

national <strong>in</strong>terest.<br />

This challenge lies at <strong>the</strong> heart of our review, <strong>the</strong> aim of which is <strong>to</strong> streng<strong>the</strong>n<br />

mechanisms of control of <strong>the</strong> civilian <strong><strong>in</strong>telligence</strong> structures <strong>in</strong> South Africa <strong>in</strong><br />

order <strong>to</strong> ensure full compliance and alignment with <strong>the</strong> Constitution,<br />

<strong>constitutional</strong> pr<strong>in</strong>ciples and <strong>the</strong> rule of law, and particularly <strong>to</strong> m<strong>in</strong>imise <strong>the</strong><br />

potential for illegal conduct and abuse of power.<br />

2.3 The Primacy of <strong>the</strong> Constitution<br />

The role, character and activities of <strong><strong>in</strong>telligence</strong> organisations throw up a<br />

number of difficult questions <strong>in</strong> democratic countries. What should be <strong>the</strong><br />

primary focus of <strong>the</strong>se organisations? What powers should <strong>the</strong>y have and<br />

what limits should be placed on those powers? How can abuse of power be<br />
