Any <strong><strong>in</strong>telligence</strong> service o<strong>the</strong>r than an <strong><strong>in</strong>telligence</strong> division of <strong>the</strong> defence<br />

force or police service may be established only by <strong>the</strong> President, as head<br />

of <strong>the</strong> national executive, and only <strong>in</strong> terms of national legislation. 15<br />

National legislation must regulate <strong>the</strong> objects, powers and functions of <strong>the</strong><br />

<strong><strong>in</strong>telligence</strong> services. 16<br />

In light of <strong>the</strong>se provisions, we reject <strong>the</strong> view that it is legitimate for<br />

<strong><strong>in</strong>telligence</strong> officers <strong>to</strong> bend or break <strong>the</strong> rules when deal<strong>in</strong>g with serious<br />

threats <strong>to</strong> security (Section 11.6).<br />

2.5 Non-Partisanship and Promotion and Respect for Rights<br />

In <strong>the</strong> nature of <strong>the</strong>ir bus<strong>in</strong>ess, which <strong>in</strong>cludes <strong>in</strong>trusive operations and<br />

collect<strong>in</strong>g secret <strong>in</strong>formation, <strong>the</strong>re is a risk that <strong><strong>in</strong>telligence</strong> services might<br />

<strong>in</strong>terfere <strong>in</strong> lawful political activity, favour<strong>in</strong>g some political parties,<br />

organisations or leaders and prejudic<strong>in</strong>g o<strong>the</strong>rs. In many countries <strong>the</strong>y have<br />

done this by <strong>in</strong>filtrat<strong>in</strong>g organisations, spy<strong>in</strong>g on politicians and activists,<br />

leak<strong>in</strong>g confidential <strong>in</strong>formation about political leaders and spread<strong>in</strong>g<br />

malicious rumours <strong>in</strong> political and media circles.<br />

Malpractices of this k<strong>in</strong>d might be <strong>in</strong>itiated by <strong><strong>in</strong>telligence</strong> officers or by<br />

politicians who have control or <strong>in</strong>fluence over <strong>the</strong> <strong><strong>in</strong>telligence</strong> services.<br />

Whichever is <strong>the</strong> case, such malpractices would constitute a serious breach<br />

of trust and underm<strong>in</strong>e <strong>the</strong> democratic system so severely that <strong>the</strong>y can be<br />

considered a form of subversion. If exposed publicly, <strong>the</strong>y can create a longlast<strong>in</strong>g<br />

crisis of confidence <strong>in</strong> <strong>the</strong> <strong><strong>in</strong>telligence</strong> services and <strong>the</strong> government.<br />

The Constitution <strong>the</strong>refore <strong>in</strong>sists that members of <strong>the</strong> security services must<br />

be strictly non-partisan:<br />
