<strong>Constitutional</strong>ism and Secularism: the Need for Public Reason<br />

in the public debate, as all people, all honest motives, and all arguments. A soup kitchen might<br />

be run because <strong>of</strong> religious convictions and it will remain an act <strong>of</strong> salvation <strong>of</strong> the soul. But as far<br />

as law is concerned it remains soup distribution that should follow neutral sanitation and welfare<br />

service rules.<br />

Let me come back to Lefort’s powerful paradigm <strong>of</strong> secularism. The banishment or withdrawal <strong>of</strong><br />

religion from the public square has left a hollow space behind. There are no fixed rules and structures<br />

here, and democracy, or other forces fill the void in a continuous process. It matters for constitutionalism<br />

what the rules <strong>of</strong> filling the void are; and constitutional jurisprudence should stand for<br />

the idea that secular laws should set the rules <strong>of</strong> engagement.<br />
