The Blank-Prose Crime <strong>of</strong> Aggression<br />

Contrasting cultural understandings might emphasize divergent strands <strong>of</strong> meaning, but none need<br />

necessarily control if political agreement can be reached to jettison vague or irreconcilable elements.<br />

No legalist impediment stands in the way <strong>of</strong> sculpting a finely shaped, juridically acceptable<br />

criminal <strong>of</strong>fense with respect to aggression. The obstacle to consensus has not been international<br />

law.<br />

To take only one <strong>of</strong> many possible illustrations, the nub <strong>of</strong> a definition might lie in the second<br />

exemplar set out in Resolution 33l4 (which many would regard as coming close, historically, to the<br />

core meaning <strong>of</strong> the term): “any annexation by the use <strong>of</strong> force <strong>of</strong> the territory <strong>of</strong> another State or<br />

part there<strong>of</strong>.” 203 Key terms, even in so short a definition as this, would still require extensive refinement.<br />

“Annexation,” for example, might or might not include setting up a puppet state rather than<br />

outright incorporation. 204 “Force” itself requires extensive clarification, as indicated earlier, 205 as it<br />

might or might not include threats <strong>of</strong> force. Also, whether the “annexed” state was earlier a part<br />

<strong>of</strong> the “aggressor” state, or a separate, independent entity, can be anything but self-evident (consider<br />

the Iraqi invasion <strong>of</strong> Kuwait, 206 the Chinese invasion <strong>of</strong> Tibet, 207 and the Argentine invasion <strong>of</strong><br />

the Falklands, 208 all <strong>of</strong> which proceeded in the wake <strong>of</strong> claims <strong>of</strong> historical title) and would require<br />

considerable elaboration. But there is no “inherent” impediment to meeting the required level <strong>of</strong><br />

particularity. It is linguistically and conceptually possible. The key would be to agree upon a single<br />

historical example that all agree constituted aggression, such as the l939 German invasion <strong>of</strong> Poland,<br />

to describe it in legalist terms with great specificity, and to thus ensure that the description<br />

excludes additional uses <strong>of</strong> force that lie beyond the consensus.<br />

Nor does any legalist reason exist why a crime <strong>of</strong> aggression cannot be prosecuted by the ICC in<br />

harmony with an amended U.N. Charter. In principle, a decision <strong>of</strong> the Security Council on whether<br />

given conduct constitutes an act <strong>of</strong> aggression could, for example, be made reviewable by the ICC,<br />

subject to specified, preexisting standards and not subject to the existing veto. The possibility <strong>of</strong><br />

arbitrary and discriminatory enforcement could thereby be significantly curtailed. Alternatively, the<br />

supremacy provision <strong>of</strong> Article l03 could be made inapplicable with respect to new provisions concerning<br />

aggression in the Rome Statute. Formal amendment <strong>of</strong> the Charter would be required for<br />

either approach; given the historical obstacles to Charter amendment, this course would not be<br />

politically realistic. But, purely as a matter <strong>of</strong> law, it is conceptually feasible.<br />

Rather, the reasons why agreement upon a legally sound definition has proven elusive are cultural<br />

and political. Historical differences among states and disparities in military and economic power<br />

have generated pr<strong>of</strong>ound disagreement over when force may appropriately be used. 209 Some states<br />
