• Annex B: necessity for import, export <strong>and</strong> re-export permits for <strong>the</strong> species listed, <strong>in</strong> a way<br />

similar to CITES Appendix II species. It goes fur<strong>the</strong>r than CITES Appendix II, however,<br />

as import permits are required for Annex B specimens. It conta<strong>in</strong>s all rema<strong>in</strong><strong>in</strong>g CITES<br />

Appendix II specimens, Appendix I species subject to reservations <strong>and</strong> o<strong>the</strong>rs that may<br />

be threatened by <strong>trade</strong> or pose a threat to <strong>in</strong>digenous <strong>wildlife</strong>, even if not CITES-listed.<br />

• Annex C: imports of species listed here, conta<strong>in</strong><strong>in</strong>g <strong>the</strong> CITES Appendix III species not<br />

listed <strong>in</strong> Annex B, are not subject to import permit requirements. However, a CITES<br />

(re)export document <strong>and</strong> <strong>the</strong> stricter measure of an import notification are required.<br />

• Annex D: conta<strong>in</strong>s non-CITES species not listed <strong>in</strong> <strong>the</strong> above annexes but imported <strong>in</strong>to <strong>the</strong><br />

EC <strong>in</strong> large enough numbers to require monitor<strong>in</strong>g <strong>in</strong> order that any potential conservation<br />

threat can be responded to. It also conta<strong>in</strong>s CITES Appendix III species subject to a<br />

reservation.<br />

General import restrictions are imposed under <strong>the</strong> regulation <strong>in</strong> Article 4. They aim to ensure<br />

certa<strong>in</strong>ty <strong>in</strong> <strong>the</strong> operation of <strong>the</strong> system, so that all member states are deal<strong>in</strong>g <strong>in</strong> <strong>the</strong> same<br />

manner. Fur<strong>the</strong>r considerations <strong>in</strong>clude <strong>the</strong> possibility <strong>in</strong> limited circumstances of retrospective<br />

issuance of relevant permits 19 , <strong>and</strong> a list of exceptions to <strong>the</strong> import/export condition.<br />

Important provisions relat<strong>in</strong>g to <strong>in</strong>ternal <strong>trade</strong> are <strong>in</strong>cluded <strong>in</strong> Article 8, <strong>and</strong> cover <strong>the</strong> <strong>trade</strong><br />

between member states <strong>and</strong> any <strong>trade</strong> with<strong>in</strong> a member state. Prohibitions relat<strong>in</strong>g to <strong>trade</strong><br />

aspects of Annex A specimens are set out, which <strong>in</strong> certa<strong>in</strong> circumstances may be extended to<br />

apply to Annex B, <strong>and</strong> are subject to exemptions on both general <strong>and</strong> specific grounds 20 . Fur<strong>the</strong>r<br />

restrictions are placed on movements of live specimens, which take account of <strong>the</strong> facilities for<br />

hous<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g <strong>the</strong>m at <strong>the</strong>ir place of dest<strong>in</strong>ation.<br />

Enforcement provisions are conta<strong>in</strong>ed <strong>in</strong> Articles 14 <strong>and</strong> 15 <strong>and</strong> place primary responsibility for<br />

<strong>the</strong> monitor<strong>in</strong>g <strong>and</strong> compliance requirements upon <strong>the</strong> competent authorities of <strong>the</strong> member<br />

states. An enforcement group, compris<strong>in</strong>g representatives from <strong>the</strong> member states, has been<br />

established <strong>and</strong> fills an advisory role for enforcement issues. Additionally, species-specific<br />

restrictions, suspend<strong>in</strong>g <strong>the</strong> <strong>in</strong>troduction of certa<strong>in</strong> species <strong>in</strong>to <strong>the</strong> EC, are issued from time to<br />

time 21 <strong>in</strong> a similar way that country-specific bans were under previous regulation.<br />

The pr<strong>in</strong>cipal EC regulation is generally perceived as an improvement on its predecessor <strong>and</strong> its<br />

effect has been to improve <strong>the</strong> enforcement climate <strong>in</strong> relation to illegal <strong>wildlife</strong> <strong>trade</strong>. The<br />

enlargement of <strong>the</strong> EU will offer a fur<strong>the</strong>r opportunity to extend <strong>the</strong> reach of <strong>the</strong> provisions. But<br />

a strong lead from those countries with adequate <strong>punishment</strong> for <strong>wildlife</strong> <strong>trade</strong> offenders is<br />

needed to push <strong>the</strong> agenda, so that newly-acceded countries do not become <strong>the</strong> <strong>in</strong>ternal market’s<br />

weak l<strong>in</strong>ks. Discrepancies <strong>in</strong> some member states’ laws are explored fur<strong>the</strong>r <strong>in</strong> chapter 4.<br />

<strong>UK</strong> LEGISLATIVE PROVISONS<br />

EC regulations 22 are directly applicable <strong>in</strong> <strong>the</strong> <strong>UK</strong>, <strong>and</strong> all <strong>the</strong> provisions above are part of <strong>the</strong><br />

<strong>UK</strong>’s legal system. The specific legal obligations are enforced through a comb<strong>in</strong>ation of two<br />

legislative provisions. The Customs <strong>and</strong> Excise Management Act 1979 (CEMA), enforced by<br />
