charged with sell<strong>in</strong>g tarantula spiders that had been collected <strong>in</strong> contravention of Mexican law.<br />
This breach of <strong>the</strong> Mexican law was able to serve as <strong>the</strong> Lacey Act trigger, result<strong>in</strong>g <strong>in</strong> a<br />
felony conviction.<br />
F<strong>in</strong>ally, <strong>the</strong> US’s Smuggl<strong>in</strong>g Statute 50 aims to combat illegal import<strong>in</strong>g <strong>in</strong>to <strong>the</strong> US <strong>and</strong> is also<br />
concerned with <strong>the</strong> non-declaration of imported <strong>wildlife</strong>. Proof is required that a person<br />
know<strong>in</strong>gly imported merch<strong>and</strong>ise contrary to ano<strong>the</strong>r US law, even if it is only an<br />
adm<strong>in</strong>istrative regulation. The Act triggers a felony charge <strong>and</strong> can potentially lead to tax<br />
evasion charges if a defendant fails to report or conceals <strong>in</strong>come generated by illegal smuggl<strong>in</strong>g.<br />
The effect of a conviction can be severe. In <strong>the</strong> case of United States v Silva 51 a defendant<br />
convicted of conspir<strong>in</strong>g to smuggle exotic birds <strong>in</strong>to <strong>the</strong> US <strong>and</strong> fail<strong>in</strong>g to report taxable <strong>in</strong>come<br />
was sentenced to 82 months’ imprisonment <strong>and</strong> f<strong>in</strong>ed US$100,000 52 .<br />
