Part 8, Class A permits the extension<br />

or alteration of an industrial building or<br />

a warehouse. Development is not<br />

permitted if the floorspace of the<br />

original building is exceeded by more<br />

than 750 sq m or the cubic content of<br />

the original building is exceeded by<br />

more than 20%. This right is subject to<br />

certain other conditions regarding the<br />

buildings use; the extension’s height;<br />

its external appearance; proximity to<br />

the premises curtilage; whether the<br />

developments’ premises adjoins the<br />

curtilage of a dwellinghouse or flat; its<br />

impact on parking spaces or turning<br />

areas; location in the conservation<br />

area, AONB or National Park and the<br />

time of day its to be used.<br />

Revised Part 8 – Industrial, research/development &<br />

storage uses<br />

Permitting a maximum of 1,000 sq m floorspace for<br />

extensions and alterations per building (500 sq m in<br />

AONBs, CAs & National Parks, 250 sq m in<br />

floodplains) and up to max of 25 per cent extra<br />

floorspace;<br />

Height no greater than existing building, if within 10m<br />

of a boundary max height of 5m;<br />

A maximum floorspace of 100 sq m per new building;<br />

Not within 5m of a boundary or facing a highway;<br />

Materials to match existing building;<br />

Not within 10m of a boundary of a residential property;<br />

Not permitted development within the curtilage of a<br />

Listed Building unless Listed Building Consent for the<br />

development has previously been granted;<br />

Max 50 per cent ground coverage;<br />

Permeable (or porous) hardstanding up to 100 sq m<br />

(impermeable (or non-porous) where risk of<br />

contamination); and<br />

No basements in floodplains.<br />

Delete the test of ‘material effect on external appearance’,<br />

and replace with a test similar to that for <strong>householder</strong><br />

development. This takes into account development facing a<br />

highway and distance from boundary (as used in revised<br />

Part 8).<br />

Extended Part 8 PD rights are to be<br />

provided in Conservation Areas<br />

(CAs), Areas of Outstanding Natural<br />

Beauty (AONBs) & National Parks<br />

(NPs) up to a restrained floorspace<br />

limit of 500 sq m. Further they are<br />

permitted up to a floorspace of 250 sq<br />

m on floodplains.<br />

Development and excavation on sites<br />

of natural, archaeological or<br />

geological value offers the potential to<br />

destroy such characteristics and<br />

therefore conditions to take away PD<br />

rights in ASSIs & SAIs are proposed<br />

for Class A of Part 8 (permitting<br />

extensions, alterations & new build).<br />

Specifically exclude incineration<br />

operations from Part 8 rights – only<br />

large scale incineration processes<br />

should be excluded.<br />
