PART 6 - AGRICULTURAL<br />

BUILDINGS AND OPERATIONS<br />

Class A - <strong>The</strong> carrying out on<br />

agricultural land comprised in an<br />

agricultural unit of:<br />

(a) works for the erection, extension or<br />

alteration of a building; or<br />

(b) any excavation or engineering<br />

operations; reasonably necessary for<br />

the purposes of agriculture within that<br />

unit.<br />

Class B - <strong>The</strong> winning and working on<br />

land held or occupied with land used<br />

for the purposes of agriculture of any<br />

minerals reasonably necessary for<br />

agricultural purposes within the<br />

agricultural unit of which it forms part.<br />

Class C - <strong>The</strong> construction, formation,<br />

laying out or alteration of a means of<br />

access to a road.<br />

Amendment to Part 3 to allow change of use of an<br />

agricultural building to:<br />

<strong>The</strong> making of products from produce/ materials<br />

grown or reared on the farm;<br />

<strong>The</strong> selling of produce/products grown within a 10<br />

mile radius, and other products which account for no<br />

more than 20% of the sales area;<br />

Storage and distribution uses (but no subsequent<br />

change to B1 or B2).<br />

<strong>The</strong> following limitations are proposed for these three rights:<br />

- Farm unit to be larger than 0.5 hectares;<br />

- <strong>The</strong> total amount of land or buildings used for<br />

farm diversification purposes shall not exceed<br />

235m² per agricultural unit, of which no more<br />

than 120m² shall comprise a farm shop;<br />

- At least 80 per cent of the sales area in farm<br />

shops shall be given over to produce/products<br />

grown within a 10 mile radius;<br />

- <strong>The</strong> buildings have been in an agricultural use<br />

for 5 or more years and are of permanent<br />

construction;<br />

- Not permitted development within the curtilage of<br />

a Listed Building unless Listed Building Consent<br />

for the development has previously been<br />

granted;<br />

- the building shall continue to be part of the<br />

agricultural unit; and<br />

- If the building is no longer needed for one of<br />

these uses it shall revert to an agricultural use.<br />

Equestrian Uses<br />

Further the following extended PD rights regarding<br />

equestrian use are recommended:<br />

Change of use of land to recreational equestrian use<br />

subject to the area being no smaller than 1 ha, subject<br />

to:<br />

- No more than two horses at any one time being<br />

kept on any 1ha plot;<br />

- <strong>The</strong> 1ha site not being subdivided in anyway and<br />

all the land being kept available for the grazing<br />

and keeping of horses at all times; and<br />

- No equestrian business to be carried out.<br />

Amended PD rights in Part 3 to be<br />

permitted in AONBs, National Parks,<br />

CAs, ASSIs & SAIs.<br />

Proposed PD rights to be permitted in<br />

NPs, AONBs & CAs but removed in<br />

ASSIs & SAIs.<br />

<br />

<strong>The</strong> erection, construction, maintenance, and<br />

improvement of a fence, wall or other means of<br />

enclosure of recreational equestrian land, subject to:<br />

- No fences, walls or structures of any kind shall<br />

be erected if these subdivide the 1ha site area;<br />

and<br />

- No fence, walls or structures of any kind shall be<br />

erected if these exceed 1.4m in height.<br />

Proposed PD rights to be permitted in<br />

NPs, AONBs & CAs but removed in<br />

ASSIs & SAIs.<br />
