10.3 PD Rights in Other Nations<br />

Throughout the UK similar PD rights exist for minor operations and development by district councils. Similar PD<br />

rights exist for CCTV cameras in England & Wales but are not permitted in Scotland. However PD rights<br />

regarding change of use are more permissive in Northern Ireland than the rest of the UK or Republic of Ireland.<br />

Greater detail of the differences between the respective nations PD rights with regard to retail and commercial<br />

development are provided in Appendix C.<br />

10.4 Current Volume of Applications for Commercial & Retail Use<br />

<strong>The</strong> analysis of planning application data shows how many commercial & retail related applications were<br />

submitted over the period. <strong>The</strong>se are summarised in Table 10.1.<br />

Just over 35% of our sample constituted development within our commercial or retail definitions. This topic makes<br />

up the largest segment of our sample. Given the high number of applications for commercial or retail development,<br />

there is clear potential for increased PD rights within the topic, providing they can be regulated to minimise<br />

impacts on neighbours and visual amenity.<br />

10.5 <strong>Planning</strong> Policies<br />

National planning policy sets out to maintain an efficient, competitive and innovative retail sector whilst sustaining<br />

the vitality and viability of town centres. Such objectives are to be based on sustainable development principles.<br />

Development plan policy supports a retail hierarchy and in general will grant planning permission for minor<br />

external alterations subject to design and location. <strong>Planning</strong> policy for retail & commercial development is<br />

discussed in greater detail in Appendix D.<br />
