respondents consider SIPO to be an obvious<br />
and natural choice.<br />
(iii) On the other hand, those who question the need<br />
for an OGP system in Hong Kong doubt<br />
whether there would be a critical mass of OGP<br />
applications to support a cost-effective system.<br />

Short-term patents<br />
(i) Quite a number of the respondents oppose the<br />
introduction of substantive examination to the<br />
short-term patent system. Those who support<br />
substantive examination propose imposing a<br />
requirement for substantive examination before<br />
the patent owner can commence infringement<br />
proceedings.<br />
(ii) Some respondents suggest that the groundless<br />
threats provisions should be strengthened.<br />

Regulation of patent agency services<br />
(i) Different views were received regarding<br />
regulation of patent agency services. Some<br />
respondents support setting up a regulatory<br />
regime for providers of patent agency services<br />
in any event. Others see a need for a<br />
regulatory regime only if an OGP system is to<br />
be introduced in Hong Kong.
