1. What benefits will an OGP system bring to Hong Kong? Will an OGP system promote local innovation and enhance patent quality?<br />

Eric Yung is of the view that an OGP system can save the time and costs for<br />

obtaining patent protection in Hong Kong as it allows an applicant to apply for<br />

patent protection directly in Hong Kong without the need to first file an application<br />

with one of the designated patent offices. He opines that an OGP system can raise<br />

the society’s awareness regarding research and patents and let Hong Kong entities<br />

learn more about the commercial value of patents. He further believes that an OGP<br />

system can change enterprises’ view towards research and patent applications as it<br />

allows young inventors to obtain patent protection in Hong Kong at a very low cost<br />

thereby letting them earn substantial profits if large corporations decide to acquire<br />

the inventions. He also thinks that an OGP system can provide additional career<br />

opportunities for graduates with science and technical background.<br />

thinks that introducing an OGP system in Hong Kong while maintaining a<br />

re-registration system will encourage local innovation. He believes that an OGP<br />

system will create more employment opportunities for local people, especially the<br />

elderly and handicapped. He is of the view that an OGP system can attract users to<br />

apply for patents in Hong Kong and thus can increase sources of income for the<br />

Government if fees for patent search and substantive examination to be conducted<br />

are very low and conducive to the development of innovation in Hong Kong. He<br />

further comments that an OGP system can enable applicants to avoid the issue of<br />

inadequate patent protection in China or the need to pay for an agent to get a patent<br />

from SIPO.<br />

Ng Chan Wai also supports the establishment of an OGP system while maintaining a<br />

re-registration system in Hong Kong.<br />

Hui Wing Kin does not consider it necessary to introduce an OGP system in Hong<br />

Kong and comments that an OGP system will create an extra step in a patent<br />

application in Hong Kong.<br />
