Executive Summary<br />

The Review<br />

To ensure that the Hong Kong patent system continues to<br />

meet present-day circumstances and that its further evolution would<br />

facilitate the development of Hong Kong into a regional innovation and<br />

technology hub, the Administration commenced a comprehensive review<br />

of the patent system and issued a Consultation Paper entitled “Review of<br />

the Patent System in Hong Kong” in October 2011.<br />

The Advisory Committee<br />

2. The Secretary for Commerce and Economic Development<br />

appointed an Advisory Committee on Review of the Patent System in<br />

Hong Kong (the Advisory Committee) in the same month to advise him<br />

on –<br />

(a)<br />

(b)<br />

how the Administration should position our patent<br />

system, having regard to the issues outlined in the<br />

public consultation paper of October 2011 and the<br />

responses received; and<br />

how best to implement changes to the patent system,<br />

in light of the decisions made by the Administration<br />

on the way forward.<br />

3. The Advisory Committee held a total of six meetings<br />

between October 2011 and November 2012. Having carefully examined<br />

the submissions of the respondents to the consultation document and all<br />

relevant considerations, including the patent systems in other jurisdictions,<br />

the Advisory Committee submitted a report to the Administration in<br />

December 2012.<br />

Key Recommendations<br />

4. The key recommendations made by the Advisory Committee<br />

are summarised as follows –
