make an award when it is determined to be in the best interest <strong>of</strong><br />

the County <strong>of</strong> Los Angeles to do so.<br />

1.15.3 GROUNDS FOR REVIEW<br />

Unless state or federal statutes or regulations otherwise provide,<br />

the grounds for review <strong>of</strong> a solicitation for a Board-approved<br />

services contract provided for under Board Policy No. 5.055 are<br />

limited to the following:<br />

• Review <strong>of</strong> Solicitation Requirements. See <strong>RFP</strong>, Section 3.0,<br />

Proposal Submission Requirements, Subsection 3.7.<br />

• Review <strong>of</strong> a Disqualified Proposal. See <strong>RFP</strong>, Section 4.0,<br />

Selection Process and Evaluation Criteria, Subsection<br />

4.1.1.C.<br />

• Review <strong>of</strong> Proposed Contractor Selection. See <strong>RFP</strong> Section<br />

4.0, Process and Evaluation Criteria, Subsection 4.4.2.<br />

1.16 NOTICE TO PROPOSERS REGARDING THE PUBLIC RECORDS ACT<br />

1.16.1 Responses to this solicitation shall become the exclusive property<br />

<strong>of</strong> the County. Absent extraordinary circumstances, at such time as<br />

(a) with respect to the recommended Proposer's proposal, DPSS<br />

completes contract negotiations and obtains a letter from an<br />

authorized <strong>of</strong>ficer <strong>of</strong> the recommended Proposer that the<br />

negotiated contract is a firm <strong>of</strong>fer <strong>of</strong> the recommended Proposer,<br />

which shall not be revoked by the recommended Proposer pending<br />

the <strong>Department</strong>'s completion <strong>of</strong> the process under Board Policy No.<br />

5.055 and approval by the Board <strong>of</strong> Supervisors (Board) and (b)<br />

with respect to each Proposer requesting a County Review Panel,<br />

the County Review Panel convenes as a result <strong>of</strong> such Proposers'<br />

request, and (c) with respect to all other Proposers, DPSS<br />

recommends the recommended Proposer(s) to the Board and such<br />

recommendation appears on the Board agenda, proposals<br />

submitted in response to this solicitation become a matter <strong>of</strong> public<br />

record, with the exception <strong>of</strong> those parts <strong>of</strong> each proposal which are<br />

justifiably defined under the <strong>Public</strong> Records Act as business or<br />

trade secrets, and, if by the Proposer, plainly marked as "Trade<br />

Secret," "Confidential," or "Proprietary."<br />

1.16.2 The County shall not, in any way, be liable or responsible for the<br />

disclosure <strong>of</strong> any such record or any parts there<strong>of</strong>, if disclosure is<br />

required or permitted under the California <strong>Public</strong> Records Act or<br />

otherwise by law. A blanket statement <strong>of</strong> confidentiality or the<br />

marking <strong>of</strong> each page <strong>of</strong> the proposal as confidential shall not<br />

be deemed sufficient notice <strong>of</strong> exception. The Proposers must<br />

specifically label only those provisions <strong>of</strong> their respective<br />
