<strong>Thank</strong> <strong>you</strong> <strong>very</strong> <strong>much</strong> <strong>for</strong> <strong>inviting</strong> <strong>me</strong> <strong>to</strong> <strong>speak</strong> <strong>at</strong> <strong>the</strong> Nautischer <strong>Verein</strong>. The <strong>me</strong>re words<br />

are important <strong>to</strong> <strong>me</strong>: “Nautisch” because it refers <strong>to</strong> my original profession and voc<strong>at</strong>ion.<br />

“<strong>Verein</strong>” because I am linked <strong>to</strong> a “<strong>Verein</strong>” which probably is one of <strong>the</strong> most successful<br />

real “<strong>Verein</strong>s” or co-oper<strong>at</strong>ives in <strong>the</strong> world - <strong>the</strong> mutual P&I clubs. Mutuality is in many<br />

ways a surviving dinosaur in <strong>the</strong> roaring nineties where market <strong>for</strong>ces and extre<strong>me</strong><br />

liberalism rule <strong>the</strong> waves. In spite of this, we are alive and kicking and feel th<strong>at</strong> we are<br />

<strong>very</strong> <strong>much</strong> up front and in a position <strong>to</strong> exert so<strong>me</strong> influence on our industry.<br />

Let <strong>me</strong> initially apologize <strong>for</strong> my poor command of <strong>you</strong>r language: Although our n<strong>at</strong>ions<br />

are so closely linked <strong>to</strong> each o<strong>the</strong>r in terms of his<strong>to</strong>ry, culture and language family, it is<br />

un<strong>for</strong>tun<strong>at</strong>ely a fact th<strong>at</strong> <strong>the</strong> “lingua franca” of our profession -English- has permanently<br />

damaged my ability <strong>to</strong> respond sensibly <strong>to</strong> questions in German. As a Norwegian, I am<br />

quite good <strong>at</strong> improvising, but I need plenty of ti<strong>me</strong> <strong>to</strong> prepare <strong>for</strong> it!<br />

You have asked <strong>me</strong>, firstly, if <strong>the</strong> P&I-clubs have an influence in improving mariti<strong>me</strong><br />

safety, - secondly, can we set effective initi<strong>at</strong>ives in this connection, and thirdly, is <strong>the</strong><br />

premium a useful <strong>to</strong>ol <strong>for</strong> handling <strong>the</strong> issue. I believe <strong>the</strong> answers are yes - yes and<br />

partly no. I will deal with <strong>the</strong> l<strong>at</strong>ter point first.<br />

The setting of a premium in a P&I Club is a complex oper<strong>at</strong>ion and really goes <strong>to</strong> <strong>the</strong> heart<br />

of <strong>the</strong> concept of mutuality. As club employees, it is our oblig<strong>at</strong>ion <strong>to</strong> make sure th<strong>at</strong> <strong>the</strong><br />

premium we put down as a starting point - <strong>the</strong> advance call - is, on <strong>the</strong> one hand, a<br />

professional and reasoned assess<strong>me</strong>nt of <strong>the</strong> long term exposure we expect <strong>to</strong> encounter<br />

as a consequence of <strong>the</strong> trading p<strong>at</strong>tern of <strong>the</strong> vessel involved. On <strong>the</strong> o<strong>the</strong>r hand, it is our<br />

duty always <strong>to</strong> have our eyes on <strong>the</strong> o<strong>the</strong>r <strong>me</strong>mbers of <strong>the</strong> club: will this new ship be a<br />

charge on <strong>the</strong> rest of <strong>the</strong> club community? A number of fac<strong>to</strong>rs must be taken in<strong>to</strong><br />

consider<strong>at</strong>ion - none of <strong>the</strong>m scientific, so<strong>me</strong> partly st<strong>at</strong>istical and perhaps <strong>the</strong> most<br />

important consider<strong>at</strong>ions are based on experience and sheer old fashioned gut-feeling.<br />

Ship type, trading p<strong>at</strong>tern, contracts of carriage, crewing details are all ele<strong>me</strong>nts which<br />

can be isol<strong>at</strong>ed in a computer and made <strong>to</strong> <strong>for</strong>m an opinion on how similar risks have<br />

affected us in <strong>the</strong> past. But <strong>the</strong> final judge<strong>me</strong>nt must co<strong>me</strong> from <strong>the</strong> heart and mind of an<br />

experienced human being: does this make sense? Do we know <strong>the</strong>se opera<strong>to</strong>rs? Do we<br />

trust <strong>the</strong>m? Is this really enough? Is it <strong>to</strong>o <strong>much</strong> and really over <strong>the</strong> <strong>to</strong>p?<br />

When all <strong>the</strong>se questions have been answered and <strong>the</strong> hardware and software of <strong>the</strong><br />

situ<strong>at</strong>ion have been duly considered, <strong>the</strong> end product is supposed <strong>to</strong> be a fair and<br />

reasonable premium <strong>for</strong> a <strong>me</strong>mber and a ship we are sure th<strong>at</strong> all <strong>the</strong> fellow club<br />

<strong>me</strong>mbers would regard as acceptable.<br />

In such a clim<strong>at</strong>e, <strong>the</strong> use of premium as a <strong>to</strong>ol <strong>to</strong> improve mariti<strong>me</strong> safety appear as a<br />

contradiction in terms. Mariti<strong>me</strong> safety is actually supposed <strong>to</strong> have been considered<br />

already. The <strong>me</strong>re approval of <strong>the</strong> <strong>me</strong>mber and <strong>the</strong> ship indic<strong>at</strong>e th<strong>at</strong> this ele<strong>me</strong>nt has<br />

been considered - <strong>the</strong> <strong>me</strong>mber has a quality of oper<strong>at</strong>ion, including <strong>the</strong> safety aspect,<br />

which has been evalu<strong>at</strong>ed and found <strong>to</strong> con<strong>for</strong>m with <strong>the</strong> standards of a high quality<br />

<strong>me</strong>mbership. For a club underwriter <strong>to</strong> say th<strong>at</strong> “this <strong>me</strong>mber has such a lousy safety<br />

reput<strong>at</strong>ion th<strong>at</strong> I must slap on ano<strong>the</strong>r 30% on his premium” is unthinkable. In such a<br />

situ<strong>at</strong>ion it is far better <strong>to</strong> say good-bye <strong>to</strong> each o<strong>the</strong>r: doubts in respect of <strong>the</strong> mariti<strong>me</strong><br />

safety <strong>at</strong>titudes of a <strong>me</strong>mber are incomp<strong>at</strong>ible with <strong>me</strong>mbership of a mutual community of<br />

safety - conscious, like-minded shipowners. Or as <strong>the</strong> A<strong>me</strong>rican co<strong>me</strong>dian Groucho Marx<br />

said: “I don’t want <strong>to</strong> be <strong>me</strong>mber of a club which will accept <strong>me</strong> as a <strong>me</strong>mber!”.<br />

Summing up, <strong>the</strong>re<strong>for</strong>e: The premium “<strong>to</strong>ol” as an adjuster of loss r<strong>at</strong>io vari<strong>at</strong>ions: yes,<br />

certainly. But as a penalty <strong>for</strong> laissez-faire mariti<strong>me</strong> safety <strong>at</strong>titude: There are certain<br />

values th<strong>at</strong> <strong>you</strong> just can not blend.<br />

So wh<strong>at</strong> initi<strong>at</strong>ives can <strong>the</strong> P&I Clubs take <strong>to</strong> improve mariti<strong>me</strong> safety? A number of such<br />

initi<strong>at</strong>ives have already been taken and are in good and efficient oper<strong>at</strong>ion. I am thinking<br />

of <strong>the</strong> nu<strong>me</strong>rous initi<strong>at</strong>ives and projects in <strong>the</strong> field of loss prevention, which is in itself<br />

<strong>very</strong> <strong>much</strong> linked <strong>to</strong> mariti<strong>me</strong> safety. A ship well prepared <strong>for</strong> <strong>the</strong> avoidance of losses of<br />

various kinds - vis-à-vis personnel as well as cargo - is per definition a safe ship.<br />

Many clubs have shown gre<strong>at</strong> initi<strong>at</strong>ives here: may I single out <strong>the</strong> UK Club and <strong>the</strong> North<br />

of England Club as being particularly <strong>for</strong>ward-looking here with various videos, training<br />

sche<strong>me</strong>s and now, <strong>the</strong> l<strong>at</strong>est fashion, <strong>the</strong> CD ROM. As far as my own club is concerned,<br />

<strong>the</strong> GARD, I venture <strong>to</strong> suggest th<strong>at</strong> our concentr<strong>at</strong>ion on serious and substantial volu<strong>me</strong>s<br />

of textbooks deserves positive <strong>me</strong>ntion: Our major works on P&I in general, Tanker Safety<br />

and Oper<strong>at</strong>ion, and now our l<strong>at</strong>est volu<strong>me</strong> on Oil Pollution Avoidance and Legisl<strong>at</strong>ion are<br />

all examples of <strong>at</strong>tempts <strong>to</strong> improve mariti<strong>me</strong> safety. Our books may not be <strong>the</strong> “sexiest”<br />

examples of club influencing, but it is of course our hope th<strong>at</strong> <strong>the</strong>ir presence in owners<br />

offices, onboard ships and in training and teaching institutions will provide <strong>at</strong> least “a drop<br />

in <strong>the</strong> ocean” of improved awareness and alertness. Taken as a whole, I believe it must<br />

be said th<strong>at</strong> <strong>the</strong> P&I Clubs are <strong>very</strong> <strong>much</strong> aware of <strong>the</strong>ir duties <strong>to</strong> spread in<strong>for</strong>m<strong>at</strong>ion and<br />

dissemin<strong>at</strong>e <strong>the</strong>ir collective experiences from <strong>the</strong>ir various encounters with mishaps and<br />

accidents caused by infringe<strong>me</strong>nts of mariti<strong>me</strong> safety.<br />

And if such safety-rel<strong>at</strong>ed activities and initi<strong>at</strong>ives have developed in<strong>to</strong> so<strong>me</strong>thing of an<br />

inter-club “brownie points” competition - so <strong>much</strong> <strong>the</strong> better! The harvester of <strong>the</strong> benefit is<br />

mariti<strong>me</strong> safety.<br />

Where do <strong>the</strong> clubs go <strong>to</strong> fur<strong>the</strong>r <strong>the</strong> cause of mariti<strong>me</strong> safety? It is my personal opinion<br />

th<strong>at</strong> two major lines of activity will be 1) <strong>to</strong> give positive support <strong>to</strong> <strong>the</strong> en<strong>for</strong>ce<strong>me</strong>nt of<br />

recent intern<strong>at</strong>ional legisl<strong>at</strong>ion, such as <strong>the</strong> ISM code and STCW-convention, and 2) in <strong>the</strong><br />

longer term prospect <strong>to</strong> make possible a co-oper<strong>at</strong>ion - probably including a certain<br />

financial commit<strong>me</strong>nt - <strong>to</strong>wards mariti<strong>me</strong> educ<strong>at</strong>ion in <strong>the</strong> widest sense.<br />

The ISM code will be our first hurdle. I wish I could stand here and give <strong>you</strong> a precise,<br />

black-and-white description of how we as clubs will en<strong>for</strong>ce our rules vis-à-vis ISM code<br />

infringe<strong>me</strong>nts. Experience has taught <strong>me</strong>, however, th<strong>at</strong> however good our planning may<br />

be, we will run in<strong>to</strong> extraordinary situ<strong>at</strong>ions, all of which have <strong>to</strong> be dealt with singularly<br />

and on <strong>the</strong>ir own <strong>me</strong>rits. But I do know th<strong>at</strong> <strong>the</strong> clubs have all given a strong commit<strong>me</strong>nt<br />

<strong>to</strong> <strong>the</strong> code in <strong>the</strong> knowledge th<strong>at</strong> this is a major step <strong>for</strong>ward and, ideally, a step which all<br />

opera<strong>to</strong>rs must take, simultaneously and with profound effects on economy and<br />

oper<strong>at</strong>ions if non-compliance cause breaks in planned schedules. The clubs will certainly<br />

stand behind such moves. However, preferably be<strong>for</strong>e such dram<strong>at</strong>ic occurrences take<br />

place, club intervention may be on <strong>the</strong> cards: Club surveying activities or in<strong>for</strong>m<strong>at</strong>ion<br />

derived from on-going claims m<strong>at</strong>ters may result in pro-active and perhaps confront<strong>at</strong>ional<br />

situ<strong>at</strong>ions such as “Dear Member - <strong>you</strong>r less- than perfect packings on <strong>you</strong>r h<strong>at</strong>ches will<br />

sooner or l<strong>at</strong>er turn in<strong>to</strong> an ISM code non-compliance crisis: please fix <strong>the</strong>m soonest - until<br />

<strong>you</strong> have done so, we must un<strong>for</strong>tun<strong>at</strong>ely take away <strong>you</strong>r cover <strong>for</strong> seaw<strong>at</strong>er damage <strong>to</strong><br />

<strong>the</strong> cargo caused by <strong>the</strong>se faulty packings”. Such actions are taken <strong>to</strong>day as well, and<br />

have a wonderful mind-concentr<strong>at</strong>ing effect. Un-pleasant as such episodes may be, <strong>the</strong>y<br />

are never<strong>the</strong>less contributions <strong>to</strong> improved mariti<strong>me</strong> safety.<br />

But are we as insurers being perceived as safety-conscious and quality conscious?<br />

Apparently not. In a seminar on marine risk assess<strong>me</strong>nt in London recently, reported in<br />

<strong>the</strong> Fairplay magazine, a represent<strong>at</strong>ive of one of <strong>the</strong> major brokers said th<strong>at</strong> “quality does<br />

not pay”.<br />

He could see no point in more legisl<strong>at</strong>ion unless <strong>the</strong>re was an end reward <strong>for</strong> quality.<br />

“Insurance has not been a fac<strong>to</strong>r in driving out substandard shipping, which it should be” it<br />

was said, and continued: “So<strong>me</strong> underwriters and re-insurers are happy <strong>to</strong> be writing any<br />

risk in a soft market, just when insurers and re-insurers should be busy examining <strong>the</strong><br />

funda<strong>me</strong>ntals of <strong>the</strong> risks <strong>the</strong>y are underwriting.”<br />

Perhaps mainly ai<strong>me</strong>d <strong>at</strong> <strong>the</strong> Hull and Machinery and Cargo sec<strong>to</strong>rs of insurance, I am<br />

afraid th<strong>at</strong> <strong>the</strong>se serious alleg<strong>at</strong>ions are also, <strong>to</strong> so<strong>me</strong> extent, relevant <strong>for</strong> P&I.<br />

Substandard ships are still getting insured, and ship opera<strong>to</strong>rs know th<strong>at</strong> it is still cheaper<br />

<strong>to</strong> insure against <strong>the</strong> cost of a c<strong>at</strong>astrophe than <strong>to</strong> pay <strong>for</strong> <strong>me</strong>asures <strong>to</strong> prevent it.<br />

If this is how <strong>the</strong> system works, and if this is how we are perceived by <strong>the</strong> general public,<br />

our industry has a serious struggle ahead of us. The old cynical insurance mantra “There<br />

is a premium level available <strong>to</strong> m<strong>at</strong>ch any risk” just isn’t true - or <strong>at</strong> least, should not be<br />

true in <strong>the</strong> realm of mutual P&I.<br />

Certain opera<strong>to</strong>rs should simply be <strong>for</strong>ced <strong>to</strong> <strong>me</strong>nd <strong>the</strong>ir ways by being un-insurable as<br />

fringe-quality opera<strong>to</strong>rs - as I have <strong>me</strong>ntioned earlier, a P&I club should not offer terms if<br />

<strong>the</strong>re is <strong>the</strong> least doubt about <strong>the</strong> safety consciousness of <strong>the</strong> manage<strong>me</strong>nt company. As<br />

Madam Nancy Reagan said in ano<strong>the</strong>r context: “Just say no!”.<br />

Does such an <strong>at</strong>titude work? In GARD, we think it does. Over <strong>the</strong> past years, we have<br />

seen a steady decline in <strong>the</strong> number of smaller claims. On <strong>the</strong> whole, our first half year of<br />

1997 produced a 28 percent reduction in claims value. We believe it has <strong>to</strong> do with a<br />

growing number of our <strong>me</strong>mbers being ISM code certified and <strong>the</strong> fact th<strong>at</strong> any new<br />

<strong>me</strong>mber needs <strong>the</strong> scrutiny and approval of <strong>at</strong> least three direc<strong>to</strong>rs of <strong>the</strong> Associ<strong>at</strong>ion prior<br />

<strong>to</strong> acceptance. It is also probably due <strong>to</strong> <strong>the</strong> fact th<strong>at</strong> our underwriting depart<strong>me</strong>nt has<br />

achieved a pretty good ability <strong>to</strong> spot a rotten apple when <strong>the</strong>y see one and is getting<br />

increasingly clever <strong>to</strong> say “thanks, but no thanks”.<br />

Based on st<strong>at</strong>istics as well as on logic and reason, I believe this <strong>at</strong>titude is one of <strong>the</strong> most<br />

important fac<strong>to</strong>rs a P&I-club can provide <strong>for</strong> <strong>the</strong> purpose of fur<strong>the</strong>ring <strong>the</strong> cause of<br />

mariti<strong>me</strong> safety - na<strong>me</strong>ly <strong>to</strong> <strong>for</strong>ce out <strong>the</strong> sub-standard and un-serious opera<strong>to</strong>rs.<br />

Last, but not least, let <strong>me</strong> <strong>me</strong>ntion educ<strong>at</strong>ion in <strong>the</strong> widest sense. Standards and quality in<br />

this field are varied, <strong>to</strong> put it in a diplom<strong>at</strong>ic manner. Should P&I clubs be involved in <strong>the</strong><br />

providing of a better and more unified and standardised mariti<strong>me</strong> educ<strong>at</strong>ion? For <strong>the</strong> ti<strong>me</strong><br />

being <strong>the</strong>re is no such involve<strong>me</strong>nt - <strong>at</strong> least not on a major scale. Gard <strong>for</strong> instance is<br />

providing teaching capacity <strong>for</strong> <strong>the</strong> Intern<strong>at</strong>ional Mariti<strong>me</strong> University in Malmö and are<br />

taking part in various similar functions on an ad hoc basis. O<strong>the</strong>r clubs do <strong>the</strong> sa<strong>me</strong>. But<br />

<strong>for</strong> <strong>the</strong> ti<strong>me</strong> being, <strong>the</strong>re is no co-ordin<strong>at</strong>ed or collective stand.<br />

It is my personal opinion th<strong>at</strong> this may change. As shipowner-owned, and run,<br />

organis<strong>at</strong>ions, <strong>the</strong>re is an obvious vested interest in safe shipping, and safe shipping can<br />

only be achieved and maintained through <strong>the</strong> intervention of well educ<strong>at</strong>ed and safety<br />

conscious human beings. The P&I Clubs within <strong>the</strong> Intern<strong>at</strong>ional Group control 90% of <strong>the</strong><br />

world fleet and is probably <strong>the</strong> only “common denomina<strong>to</strong>r” of such a magnitude within<br />

shipping. Surely such show of <strong>for</strong>ce could be positively utilised <strong>to</strong> <strong>the</strong> benefit of all. But<br />

th<strong>at</strong> is a look in<strong>to</strong> <strong>the</strong> future.<br />
