support <strong>and</strong> monitor boards <strong>and</strong> committees on the Register in relation to<br />

compliance with the public sector Code of Ethics, Public Sector St<strong>and</strong>ards, Codes<br />

of Conduct <strong>and</strong> the Public Interest Disclosure Act 2003.<br />

4.1 Role of the Department of the Premier <strong>and</strong> Cabinet<br />

In its role in providing support for the functions of Executive Council, Cabinet <strong>and</strong><br />

Parliament, <strong>and</strong> administrative policy advice <strong>and</strong> support to ministerial offices, the<br />

Department of the Premier <strong>and</strong> Cabinet has direct involvement in the process to establish,<br />

monitor <strong>and</strong> maintain information (Database <strong>and</strong> Register) relating to <strong>Government</strong> boards<br />

<strong>and</strong> committees.<br />

The Commission considers, that as Cabinet Submissions contain the key information<br />

relating to the establishment, change <strong>and</strong> abolition of boards or committees <strong>and</strong> the<br />

associated management of their membership, the Cabinet Services Division of the Cabinet<br />

Secretariat should continue to be the operational area with responsibility <strong>and</strong> accountability<br />

for managing the <strong>Government</strong> boards <strong>and</strong> committees Database <strong>and</strong> Register.<br />

It is the Commission's view that, the Cabinet Services Division of the Cabinet<br />

Secretariat should have exclusive responsibility <strong>and</strong> accountability for both:<br />

1. Database of <strong>Government</strong> boards <strong>and</strong> committees; <strong>and</strong><br />

2. Register of <strong>Government</strong> boards <strong>and</strong> committees (Published List).<br />

The Department of the Premier <strong>and</strong> Cabinet should also continue in its role as the principal<br />

policy agency for matters related to <strong>Government</strong> boards <strong>and</strong> committees.<br />

4.2 Role of the Public Sector Commission<br />

The Public Sector Commissioner is a statutory office holder, the general functions of which<br />

are prescribed in S.20A of the PSM Act.<br />

The functions of the Commissioner include the following<br />

(a) to promote the overall efficiency <strong>and</strong> effectiveness of the Public Sector,<br />

having regard to the principles set out in section 7;<br />

(b) to advise Ministers, chief executive officers <strong>and</strong> chief employees of changes,<br />

improvements <strong>and</strong> management practices which, in the opinion of the<br />

Commissioner, should be implemented in order to improve the efficiency <strong>and</strong><br />

effectiveness of the whole or any part of the Public Sector;<br />

(c) to plan for the future management <strong>and</strong> operation of the Public Sector;<br />

(d) to perform other functions that are conferred on the Commissioner under this<br />

Act or any other Act.<br />
