Assist the effective operation <strong>of</strong> the port;<br />

Encourage economic growth at the port; and<br />

Minimise impacts.<br />

Clause 37 <strong>of</strong> LEP 1998 reinforces the role and function <strong>of</strong> the land within zone 4B (<strong>Port</strong> <strong>Botany</strong><br />

Zone) as a major shipping and cargo handling facility. The clause states:<br />

“The Council may grant consent to the development <strong>of</strong> land within Zone <strong>No</strong> 4B only if it<br />

is satisfied that the proposed development is, by virtue <strong>of</strong> the nature <strong>of</strong> the activity or<br />

activities involved, suited to being in close proximity to <strong>Port</strong> <strong>Botany</strong> and will not<br />

adversely affect the continued operation <strong>of</strong> the port.”<br />

As the proposal is for port use and would increase the efficiency <strong>of</strong> existing port operations and is<br />

consistent with the aims <strong>of</strong> zone 4B (<strong>Port</strong> <strong>Botany</strong> Zone) is it considered permissible with consent<br />

and is clearly consistent with clause 37.<br />

2.4.2 Development Control Plans<br />

Development activity within the Randwick City Council is also controlled through Development<br />

Control Plans (DCPs).<br />

There is only one DCP which has been adopted by Council which is relevant to the proposed <strong>Bulk</strong><br />

Liquid <strong>Berth</strong> <strong>No</strong>. 2. This is the Parking DCP 1998 (DCP 1998) which aims to provide adequate<br />

<strong>of</strong>f-street parking to meet parking demand within the City <strong>of</strong> Randwick and to specify Standards,<br />

guidelines and design parameters for parking, car parks and vehicle manoeuvring and access.<br />
