Detenti<strong>on</strong> as a Last Resort<br />
The C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> Rights <strong>of</strong> <strong>the</strong> Child asserts that <strong>the</strong> principle <strong>of</strong> detenti<strong>on</strong> as a<br />
last resort has a number <strong>of</strong> elements:<br />
• <strong>the</strong> decisi<strong>on</strong> to detain a young pers<strong>on</strong> is made by a trust or court<br />
• <strong>the</strong> decisi<strong>on</strong> is in <strong>the</strong> best interests <strong>of</strong> <strong>the</strong> young pers<strong>on</strong><br />
• o<strong>the</strong>r alternate opti<strong>on</strong>s have been exhausted<br />
• <strong>the</strong>re is no o<strong>the</strong>r appropriate resp<strong>on</strong>se<br />
• <strong>the</strong>re is an expectati<strong>on</strong> <strong>of</strong> a positive outcome for <strong>the</strong> young pers<strong>on</strong><br />
The United Nati<strong>on</strong>s C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> Rights <strong>of</strong> <strong>the</strong> Child c<strong>on</strong>nects <strong>the</strong> best interests<br />
<strong>of</strong> <strong>the</strong> child, <strong>the</strong> right to be heard <strong>and</strong> <strong>the</strong> need to prevent young people from<br />
entering secure care in <strong>the</strong> first place. In c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> such matters, <strong>the</strong> range <strong>of</strong><br />
specialist services required to meet <strong>the</strong> <strong>on</strong>going needs <strong>of</strong> young people in an<br />
alternative setting to secure care defines <strong>the</strong> resp<strong>on</strong>sibility <strong>of</strong> <strong>the</strong> trust under this<br />
principle.<br />
1.6. Methodology<br />
A range <strong>of</strong> methodologies have been used in this inspecti<strong>on</strong>, including an<br />
assessment <strong>of</strong> primary data from <strong>the</strong> young peoples' statutory case records, face to<br />
face interviews with <strong>the</strong> young people <strong>and</strong> with a range <strong>of</strong> social work staff,<br />
teleph<strong>on</strong>e interviews with <strong>the</strong> chair <strong>of</strong> each trusts' restricti<strong>on</strong> <strong>of</strong> liberty panel 2 <strong>and</strong> a<br />
table top review <strong>of</strong> <strong>the</strong> protocols/procedures relating to <strong>the</strong> day to day operati<strong>on</strong> <strong>of</strong><br />
<strong>the</strong> panels.<br />
The initial results <strong>of</strong> this inspecti<strong>on</strong> posed fur<strong>the</strong>r questi<strong>on</strong>s around <strong>the</strong> restricti<strong>on</strong> <strong>of</strong><br />
liberty panels <strong>and</strong> an approach based <strong>on</strong> <strong>the</strong> principles <strong>of</strong> acti<strong>on</strong> research was<br />
adopted at <strong>the</strong> latter stages <strong>of</strong> <strong>the</strong> inspecti<strong>on</strong> in an attempt to resp<strong>on</strong>d to those<br />
questi<strong>on</strong>s. The report also examines <strong>the</strong> ways in which each <strong>of</strong> <strong>the</strong> trusts' restricti<strong>on</strong><br />
<strong>of</strong> liberty panels have been established <strong>and</strong> operate. These are recognised research<br />
methods <strong>and</strong> are reflective <strong>of</strong> both a child centred <strong>and</strong> rights based approach to<br />
regulati<strong>on</strong> <strong>and</strong> oversight adopted by RQIA as <strong>the</strong> health <strong>and</strong> social care regulator for<br />
Nor<strong>the</strong>rn Irel<strong>and</strong>.<br />
This report has been structured to provide <strong>the</strong> reader with a series <strong>of</strong> 10 case<br />
studies, each outlining an overview <strong>of</strong> <strong>the</strong> young pers<strong>on</strong>'s journey through <strong>the</strong> care<br />
system, identifying <strong>the</strong> key factors that influenced <strong>the</strong>ir progressi<strong>on</strong> towards<br />
admissi<strong>on</strong> to secure accommodati<strong>on</strong>. Within this c<strong>on</strong>text, <strong>the</strong> report highlights<br />
<strong>the</strong>mes around how <strong>the</strong> trusts as corporate parents discharged <strong>the</strong>ir duties <strong>and</strong><br />
functi<strong>on</strong>s in relati<strong>on</strong> to <strong>the</strong>se 10 young people.<br />
