Mary<br />
Background<br />
Mary is a 15 year old female who had no previous history with social services.<br />
She lived with her family when she came to <strong>the</strong> attenti<strong>on</strong> <strong>of</strong> <strong>the</strong> PSNI for<br />
disorderly behaviour <strong>and</strong> was referred to social services in <strong>the</strong> South Eastern<br />
HSC Trust <strong>the</strong> following year due to absc<strong>on</strong>ding, alcohol use <strong>and</strong> sexual<br />
activity in her local community.<br />
Pathway<br />
Mary had been admitted to residential care <strong>and</strong> was presented to <strong>the</strong><br />
restricti<strong>on</strong> <strong>of</strong> liberty panel after three weeks, however, <strong>the</strong>re were no<br />
vacancies in <strong>the</strong> unit. Mary remained in <strong>the</strong> children's home <strong>and</strong> was<br />
admitted to <strong>the</strong> Juvenile Justice Centre two m<strong>on</strong>ths later.<br />
Best Interests <strong>and</strong> <strong>the</strong> Decisi<strong>on</strong> to Admit to Residential <strong>Care</strong><br />
Mary had received social work support for <strong>on</strong>e year following a referral from<br />
<strong>the</strong> police. By this stage Mary had a well established behaviour pattern which<br />
culminated in a lengthy period <strong>of</strong> absc<strong>on</strong>ding from parental care. She was<br />
admitted to residential care as a resp<strong>on</strong>se to her escalating challenging<br />
behaviour.<br />
Decisi<strong>on</strong> to Refer to <strong>the</strong> Restricti<strong>on</strong> <strong>of</strong> Liberty Panel<br />
Following admissi<strong>on</strong> to care Mary's level <strong>of</strong> alcohol use <strong>and</strong> absc<strong>on</strong>ding<br />
behaviour increased as did her associati<strong>on</strong> with an older peer group from<br />
within <strong>the</strong> local community. She was presented to <strong>the</strong> restricti<strong>on</strong> <strong>of</strong> liberty<br />
panel <strong>on</strong> four separate occasi<strong>on</strong>s over a two m<strong>on</strong>th period. On each occasi<strong>on</strong><br />
<strong>the</strong>re was no placement available within <strong>the</strong> unit. Staff in <strong>the</strong> children's home<br />
struggled to engage her <strong>on</strong> underlying issues . Whilst <strong>the</strong>re was some<br />
positive engagement with <strong>on</strong>e project worker in particular, this had a limited<br />
impact <strong>on</strong> her <strong>on</strong>going behaviour pattern in <strong>the</strong> home.<br />
Mary's behaviour led to her being c<strong>on</strong>victed by <strong>the</strong> courts <strong>of</strong> a significant<br />
criminal <strong>of</strong>fence. C<strong>on</strong>sequently, she became subject to bail c<strong>on</strong>diti<strong>on</strong>s which<br />
she breached <strong>on</strong> 47 occasi<strong>on</strong>s. The PSNI was not c<strong>on</strong>sistent in its resp<strong>on</strong>se<br />
<strong>and</strong> <strong>the</strong>re was a c<strong>on</strong>tinuing lack <strong>of</strong> availability <strong>of</strong> places in secure care. In <strong>the</strong><br />
meantime Mary had resumed her risk taking activities in <strong>the</strong> community <strong>and</strong><br />
care staff observed that she felt herself to be untouchable by <strong>the</strong> adult<br />
authorities in her life. Arguably this period is likely to have provided Mary with<br />
a diminished sense <strong>of</strong> pers<strong>on</strong>al resp<strong>on</strong>sibility about <strong>the</strong> c<strong>on</strong>sequences <strong>of</strong> her<br />
acti<strong>on</strong>s.<br />
