2.1 The Restricti<strong>on</strong> <strong>of</strong> Liberty Panels<br />
Each panel is chaired at <strong>the</strong> level <strong>of</strong> Head <strong>of</strong> Children's Service /Service<br />
Manager or above. Each <strong>of</strong> <strong>the</strong> chairpers<strong>on</strong>s hold operati<strong>on</strong>al resp<strong>on</strong>sibility<br />
for <strong>the</strong> young peoples' cases referred to <strong>the</strong> panel. Given <strong>the</strong> authority<br />
inherent in this combined role, greater c<strong>on</strong>siderati<strong>on</strong> should be provided about<br />
how objectivity <strong>and</strong> equitable decisi<strong>on</strong> making can be guaranteed by this<br />
process. It is notable that <strong>the</strong> Belfast HSC Trust reported that <strong>the</strong> chairpers<strong>on</strong><br />
distances <strong>the</strong>mselves from <strong>the</strong> referral process in an effort to be more<br />
objective in <strong>the</strong>ir decisi<strong>on</strong> making.<br />
The panels in <strong>the</strong> Belfast, Nor<strong>the</strong>rn <strong>and</strong> Western trusts meet regularly <strong>on</strong> a<br />
structured basis. The Sou<strong>the</strong>rn <strong>and</strong> South Eastern trusts c<strong>on</strong>vene when<br />
requested by management or when a vacancy arises within secure<br />
accommodati<strong>on</strong>. Greater c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> <strong>the</strong> experience <strong>of</strong> <strong>the</strong> panels in<br />
respect <strong>of</strong> <strong>the</strong>se differing operating arrangements as to which model, if any, is<br />
more c<strong>on</strong>ducive to effective planning should take place to ensure maximum<br />
benefit for <strong>the</strong> young people in need <strong>of</strong> a secure care placement.<br />
Each panel is c<strong>on</strong>stituted differently <strong>and</strong> whilst <strong>the</strong>re are some similarities<br />
<strong>the</strong>re is no regi<strong>on</strong>al uniformity <strong>of</strong> compositi<strong>on</strong> in respect <strong>of</strong> attendees. With<br />
<strong>the</strong> excepti<strong>on</strong> <strong>of</strong> <strong>the</strong> Belfast Trust it was also noted that a representative from<br />
mental health services was not referenced within <strong>the</strong> policies as attending<br />
panel meetings. It was also noted that within <strong>the</strong> five trusts' policies <strong>and</strong><br />
procedures <strong>the</strong>re was no reference made to how <strong>the</strong> young pers<strong>on</strong>'s views <strong>on</strong><br />
<strong>the</strong>ir possible detenti<strong>on</strong> is sought <strong>and</strong> presented to <strong>the</strong> panel. It is fur<strong>the</strong>r<br />
noted that <strong>the</strong> regi<strong>on</strong>al trust pro forma (which must be endorsed at trust<br />
director level) to apply for secure accommodati<strong>on</strong> makes no direct reference<br />
to <strong>the</strong> view <strong>of</strong> <strong>the</strong> young pers<strong>on</strong> about <strong>the</strong> possible restricti<strong>on</strong> <strong>of</strong> <strong>the</strong>ir liberty.<br />
The five chairpers<strong>on</strong>s reported that discussi<strong>on</strong> does take place at <strong>the</strong> panel<br />
about <strong>the</strong> views <strong>of</strong> <strong>the</strong> young pers<strong>on</strong>; however core social work values <strong>and</strong><br />
good practice requires that <strong>the</strong> young pers<strong>on</strong> is placed at <strong>the</strong> centre <strong>of</strong> <strong>the</strong><br />
process. The court process attaches significance in respect <strong>of</strong> a young<br />
pers<strong>on</strong> being in attendance at court, with <strong>the</strong>ir views <strong>and</strong> wishes about <strong>the</strong><br />
applicati<strong>on</strong> being formally sought, presented <strong>and</strong> c<strong>on</strong>sidered in a structured<br />
way. The restricti<strong>on</strong> <strong>of</strong> liberty panel process, by comparis<strong>on</strong>, does not<br />
routinely have <strong>the</strong> young pers<strong>on</strong> in attendance, nor <strong>the</strong>ir views referenced <strong>on</strong><br />
<strong>the</strong> applicati<strong>on</strong>. When c<strong>on</strong>sidering <strong>the</strong> young pers<strong>on</strong>'s human rights, in<br />
particular <strong>the</strong>ir best interests <strong>and</strong> <strong>the</strong>ir right to be heard, it would be viewed as<br />
advantageous for <strong>the</strong> young pers<strong>on</strong> to have <strong>the</strong> opti<strong>on</strong> to be present at <strong>the</strong>se<br />
meetings or by agreement with <strong>the</strong> young pers<strong>on</strong> to have an identified<br />
independent pers<strong>on</strong> in attendance to represent <strong>the</strong>ir interests <strong>and</strong> to act as an<br />
advocate <strong>on</strong> <strong>the</strong>ir behalf.<br />
A senior representative from <strong>the</strong> secure accommodati<strong>on</strong> unit attends <strong>and</strong><br />
provides an input to <strong>the</strong> Belfast <strong>and</strong> South Eastern trust panels. A<br />
representative also attends <strong>the</strong> Sou<strong>the</strong>rn Trust panel however, <strong>the</strong>ir<br />
attendance is reported to be infrequent. There is no reported attendance at<br />
ei<strong>the</strong>r <strong>the</strong> Western or Nor<strong>the</strong>rn trust panels. RQIA c<strong>on</strong>siders that<br />
