Kevin<br />

Background<br />

Kevin is a 14 year old male with a c<strong>on</strong>siderable in-care history outside<br />

Nor<strong>the</strong>rn Irel<strong>and</strong> before his family moved to this jurisdicti<strong>on</strong>. His family came<br />

to <strong>the</strong> attenti<strong>on</strong> <strong>of</strong> social services in <strong>the</strong> Nor<strong>the</strong>rn HSC Trust in relati<strong>on</strong> to poor<br />

parenting, alcohol misuse <strong>and</strong> an unstable home life. Kevin's natural fa<strong>the</strong>r<br />

died when he was <strong>on</strong>e year old.<br />

Pathway to Secure Accommodati<strong>on</strong><br />

Kevin was admitted to residential care <strong>and</strong> presented to <strong>the</strong> restricti<strong>on</strong> <strong>of</strong><br />

liberty panel after seven weeks in <strong>the</strong> children's home. He was admitted to<br />

secure accommodati<strong>on</strong> <strong>on</strong> <strong>the</strong> same day as <strong>the</strong> panel met.<br />

Best Interests <strong>and</strong> <strong>the</strong> Decisi<strong>on</strong> to Admit to Residential <strong>Care</strong><br />

Kevin had lived at home with his mo<strong>the</strong>r <strong>and</strong> wanted to remain in her care but<br />

his level <strong>of</strong> vulnerability remained high. The risk management strategy<br />

showed c<strong>on</strong>siderable input by his social worker, however, <strong>the</strong> interventi<strong>on</strong><br />

strategy lacked structured support for him at evenings <strong>and</strong> weekends, when<br />

he had limited parental care or support. This led to increased engagement<br />

with <strong>the</strong> PSNI. It also increased <strong>the</strong> possibility that Kevin may be taken into<br />

care, which occurred four m<strong>on</strong>ths later.<br />

Undoubtedly Kevin was at risk when in <strong>the</strong> community however, his stated<br />

oppositi<strong>on</strong> to being removed from <strong>the</strong> care <strong>of</strong> his mo<strong>the</strong>r was an early<br />

indicator <strong>of</strong> his unwillingness to positively engage with any alternative care<br />

plan. It is important to acknowledge <strong>the</strong> complex task <strong>of</strong> helping young people<br />

<strong>and</strong> <strong>the</strong>ir families as well as <strong>the</strong> safeguarding resp<strong>on</strong>sibilities that <strong>the</strong> trust had<br />

in this case. However, given his difficult experience in <strong>the</strong> children's home<br />

<strong>and</strong> c<strong>on</strong>sidering his right to be heard, it may have been in his best interests for<br />

<strong>the</strong> trust to c<strong>on</strong>sider how <strong>the</strong>y could have involved Kevin's mo<strong>the</strong>r in such a<br />

way that it may have increased his level <strong>of</strong> co-operati<strong>on</strong> with his care plan.<br />

Due to <strong>the</strong> <strong>on</strong>going deteriorati<strong>on</strong> in his parental placement, Kevin was<br />

admitted <strong>on</strong> an emergency basis to a l<strong>on</strong>g term children's home.<br />

Decisi<strong>on</strong> to Refer to <strong>the</strong> Restricti<strong>on</strong> <strong>of</strong> Liberty Panel<br />

When Kevin entered <strong>the</strong> care system he did not receive specific risk<br />

assessment work around his admissi<strong>on</strong> to <strong>the</strong> children's home. It was<br />

reported that <strong>the</strong>re was a high level <strong>of</strong> instability in <strong>the</strong> placement due to a<br />

complex resident case-mix which created an envir<strong>on</strong>ment that prevented staff<br />

from fully resp<strong>on</strong>ding to Kevin's needs. Support from helping services<br />

struggled to engage with him during <strong>the</strong> period <strong>of</strong> his placement which left <strong>the</strong><br />

underlying reas<strong>on</strong>s for his behaviour largely untreated.<br />
