26 SDCERA will notify you at the time of your retirement if your benefit is affected by either of these IRC limits, or you may contact SDCERA for more information. Cost of living adjustments After you retire, you are eligible for an annual cost of living adjustment (COLA) up to 3%. If the Consumer Price Index (CPI) for San Diego is greater than 3%, the amount over 3% is saved for use in future years. Generally, your retirement benefit is not subject to garnishment except a court may order SDCERA to pay a portion of your benefit to a former spouse or registered domestic partner to cover judgment for spousal/ partner or child support. Your benefit is also subject to levy by the IRS for payment of delinquent federal income taxes. For example, if the CPI is 4%, SDCERA would increase your benefit by 3% and save 1%. The following year, if the CPI was 2% we would use the 1% from the saved bank and still give you a 3% increase. The COLA is a valuable benefit and will help your benefit payment keep up with inflation throughout your retirement.
