As I mentioned in my letter of29 September, the Ministry ofDefence is<br />

bound by the Code of Practice on Access to Govermnent Information. This<br />

means that we are committed to providing you with the information you<br />

require, as long as it is not exempted under the Code. However, to ensure<br />

this does not create an extra burden on the taxpayer, we have a charging<br />

regime for more complicated requests. If a request is likely to require over<br />

four hours' work, each hour's work over four hours (or part thereof) is<br />

charged at £15.00 per hour. Our estimate is that we will have to charge you<br />

£X (Question: please estimate cost, and perhaps timescale to accomplish<br />

the task) in order to sanitise and copy the papers referred to in your major<br />

questions (excluding material included in the "additional policy files 1968-<br />

81 "). I would be grateful for confirmation that you wish to proceed with this<br />

enquiry and that you are willing to meet this charge. If the cost of obtaining<br />

the information is likely to be significantly greater than our estimate<br />

suggests we will contact you again before proceeding further. (Question:<br />

are we able to copy the full 600 enclosures, or thereabouts, contained in<br />

the files referred to in the 5 questions excluding the reference to policy<br />

files 1968-81, or may we tell Dr Clarke it would be a voluminous<br />

request? If that is the case I suggest our offer might be to request him<br />

to wait till January 01 for BJ/ 5/311 but offer to copy the remaining 300<br />

enclosures. We do have, of course, to consider our answer alongside<br />

any offer we may make in respect of copying a small num her of the<br />

policy files from 1968-81.)<br />

(Question: I am not sure how to answer the third paragraph of Dr<br />

Clarke's letter. I believe one of the points he is trying to make is why<br />

files that contain material that is not subject to confidentiality may not<br />

be opened to the public. Perhaps you would add a short paragraph as<br />

Dr Clarke will, I am sure, light on files with titles such as "UFOs BBC<br />

Radio Oxford Programme" in the list of policy files and wonder why<br />

they may not be released!)
