ECHR<br />
European Convention on Human Rights, incorporated into UK law by the<br />

Family Life).<br />
ECtHR<br />
European Court <strong>of</strong> Human Rights: the court, b<strong>as</strong>ed in Str<strong>as</strong>bourg, responsible<br />
for interpreting and enforcing the ECHR. It is an institution <strong>of</strong> the <strong>Council</strong> <strong>of</strong><br />
Europe.<br />
Encryption<br />
A way <strong>of</strong> protecting a communication by applying a code, the key for which is<br />
available only to a limited number <strong>of</strong> people.<br />
‘Equality <strong>of</strong> Arms’<br />
The principle that, to ensure a fair trial, the same methods and resources<br />
should, <strong>as</strong> far <strong>as</strong> possible, be available to the defence <strong>as</strong> to the prosecution.<br />
EU Mutual Legal Assistance Convention<br />
The Convention on Mutual Assistance in Criminal Matters adopted by the EU<br />
<strong>Council</strong> <strong>of</strong> Ministers in May 2000. It aims to improve cooperation between<br />
judicial, police and customs authorities in different EU Member States, and<br />
covers cooperation in <strong>intercept</strong>ing communications.<br />
Exculpatory Material<br />
Material held by the police or other investigating agency, which is not intended<br />
to be adduced <strong>as</strong> <strong>evidence</strong> but supports the defence c<strong>as</strong>e or undermines the<br />
prosecution c<strong>as</strong>e.<br />
FISA<br />
Foreign Intelligence Surveillance Act 1978 – the US Act which regulates<br />
<strong>intercept</strong>ion for foreign intelligence purposes.<br />
GCHQ<br />
Government Communications Headquarters, the UK intelligence agency<br />
responsible for communications intelligence and information security.<br />
