dropped and the non-contact charges appear simultaneously with a guilty plea. In<br />

this case the offence would not be a sentencing occasion for a non-contact sex<br />

offence.<br />

If a “lifer,” Dangerous Offender, or other offender with an already imposed<br />

indeterminate sentence is simply revoked (returned to prison from conditional<br />

release in the community without trial) for a non-contact sexual offence that is of<br />

sufficient gravity that a person not already involved with the criminal justice<br />

system would most likely be charged with a non-contact sexual offence, this<br />

revocation of conditional release would count as a sentencing occasion for a<br />

non-contact sexual offence. Note: the evaluator should be confident that were<br />

this offender not already under sanction that it is highly likely that a non-contact<br />

sexual offence charge would be laid by police and a conviction would be likely.<br />
