Special Coding Issues<br />

Adjudication Withheld<br />

In some jurisdictions it is possible to have a disposition of “Adjudication<br />

Withheld,” in which case the offender receives a probation-like period of<br />

supervision. This is counted as a sentencing occasion because a sentence (a<br />

consequence representing a loss of freedom and/or some other cost) was given.<br />

Appeal<br />

Convictions overturned on appeal do not count as a sentencing occasion for a<br />

sexual offence.<br />

Conditional Discharges<br />

Where an offender has been charged with an offence and receives a conditional<br />

discharge, for the purposes of <strong>Static</strong>-<strong>2002</strong> a conditional discharge counts as a<br />

conviction and a sentencing occasion. (A “conditional discharge” can occur in<br />

Canada when a person is found guilty of an offence but is given conditions for<br />

release into the community that, if followed, result in the conviction being<br />

removed from their record.)<br />

Consent Decree<br />

Consent Decree counts as a sentencing occasion.<br />

Court Supervision<br />

In some states it is possible to receive a sentence of court supervision, where the<br />

court provides some degree of minimal supervision for a period (one year). This<br />

is similar to probation and counts as a sentencing occasion.<br />

Diversionary Adjudication<br />

If a person commits a criminal offence as a juvenile or as an adult and receives a<br />

diversionary adjudication (restorative justice, reparations, family group<br />

conferencing, community sentencing circles), this counts as a sentencing<br />

occasion.<br />

Extension of Sentence by a Parole Board (or similar)<br />

If a parole board assigns extra time to an offender’s sentence for a criminal<br />

offence this counts as an additional sentencing occasion if the new time<br />

extended the total sentence.<br />
