b. The parking facilities serving the proposed uses will be located on the one lot, or if<br />

located on a separate lot, the parking arrangements are permanent (e.g. through an<br />

easement, amalgamation, legal agreement, restrictive covenant or any other formal<br />

arrangement acceptable to Council);<br />

c. Parking demand both in the immediate and long term can be satisfied; and<br />

d. No substantial conflict will exist in the peak hours <strong>of</strong> operation <strong>of</strong> the uses for which the<br />

reciprocal parking arrangements are proposed."<br />

Variations to the <strong>City</strong>’s Parking and Access Policy need to be considered against the<br />

objectives <strong>of</strong> the policy. These are:-<br />

To facilitate the development <strong>of</strong> adequate parking facilities;<br />

To ensure safe, convenient and efficient access for pedestrians, cyclists and motorists;<br />

To ensure that a major parking problem is unlikely to occur;<br />

To ensure that car parking does not have a detrimental impact on the character and<br />

amenity <strong>of</strong> a residential area; and<br />

To ensure than an oversupply <strong>of</strong> parking does not occur that discourages alternative<br />

forms <strong>of</strong> transport and is detrimental to urban design and Centre character.<br />

Local Planning Policy 6.1 - Advertising Signs<br />

Under LPS3, the objectives <strong>of</strong> the Advertising Signs Policy are:-<br />

To ensure that the display <strong>of</strong> advertisements on private sites does not adversely<br />

impact on the amenity <strong>of</strong> surrounding land;<br />

To avoid a proliferation <strong>of</strong> signs on individual sites and buildings;<br />

To improve the streetscape <strong>of</strong> major roads;<br />

Encourage the rationalisation <strong>of</strong> advertising signs on individual premises;<br />

Encourage the incorporation <strong>of</strong> advertising signs into the design consideration <strong>of</strong><br />

buildings;<br />

To ensure that signs are not discriminatory or <strong>of</strong>fensive; and<br />

To ensure that signs only relate to services and products on the site.<br />

Specifically, the subject sign is considered a wall sign and is defined as follows:-<br />

“Sign which is affixed to the external part <strong>of</strong> a wall <strong>of</strong> the building but does not project more<br />

than 300mm from the wall and no part <strong>of</strong> which is above the lowest point <strong>of</strong> the eaves or<br />

ceiling <strong>of</strong> the building”.<br />

Background<br />

A development application for a Change <strong>of</strong> Use from Office (Real Estate) to Personal Care<br />

Services (Massage Therapy) was received by the <strong>City</strong> on 5 September 2012 (DA12/2051<br />

refers).<br />

The existing site comprises <strong>of</strong> a shopping centre, a drive through fast food outlet, a drive<br />

through c<strong>of</strong>fee outlet and a tavern. There have been a number <strong>of</strong> development applications<br />

approved for the subject property, both by Council and under delegated authority. These<br />

have resulted in the original car parking requirement for 500 car bays to be provided on site<br />

being reduced to the current approved level <strong>of</strong> 472 car parking bays.<br />
