<strong>City</strong> <strong>of</strong> <strong>Downey</strong><br />
• SB 812: In addition to the existing special needs groups, the <strong>City</strong> must include<br />
an analysis <strong>of</strong> the housing needs for developmentally disabled persons.<br />
• AB 1867: Under certain conditions, the <strong>City</strong> can now count multi-unit<br />
homeownership units that have been converted to affordable units toward<br />
their RHNA allocation.<br />
• SB375 Implications: For jurisdictions that do not submit their adopted 2014-<br />
2021 housing element update within 120 days <strong>of</strong> the October 2013 deadline,<br />
their housing element updates revert to a four-year cycle.<br />
The contents <strong>of</strong> this updated Housing Element comply with these amendments and all<br />
other requirements <strong>of</strong> Housing Element law.<br />
1.2.1 Regional Housing Needs Assessment<br />
Section 65583 <strong>of</strong> the Government Code sets forth the specific components to be<br />
contained in a community's housing element. Included in these requirements is an<br />
obligation on the part <strong>of</strong> local jurisdictions to provide their “fair share” <strong>of</strong> regional<br />
housing needs. Local governments and Councils <strong>of</strong> Governments (COGs) are required<br />
to determine existing and future housing need and the allocation <strong>of</strong> said need must be<br />
approved by the California Department <strong>of</strong> Housing and Community Development<br />
(HCD). <strong>Downey</strong> is a member <strong>of</strong> the Southern California Association <strong>of</strong> Governments<br />
(SCAG) and SCAG is responsible for preparing the Regional Housing Needs Assessment<br />
for the six-county territory that it represents.<br />
HCD established the planning period for the current Regional Housing Needs<br />
Assessment (RHNA) from January 1, 2014 to September 30, 2021. For the 2014-2021<br />
planning period the <strong>City</strong> was allocated a total <strong>of</strong> 814 units, including 210 for very low<br />
income, 123 for low income, 135 for moderate income, and 346 for above-moderate<br />
income households.<br />
Changes to Housing Element law, specifically, AB 1233 passed in January 2006, requires<br />
“communities that failed to comply with requirements to make available sufficient sites<br />
to meet their regional housing need in the previous planning period must, within the first<br />
year <strong>of</strong> the new planning period, zone or rezone enough sites to accommodate the<br />
RHNA not accommodated from the previous planning period.”<br />
The Housing Element for the 2008-2014 planning period was adopted in 2010 and<br />
certified by HCD, but the <strong>City</strong> was unable to complete the rezoning necessary to<br />
