Part II: Functions, Procedure to be followed by <strong>Food</strong> Laboratories under Sub-section<br />

(3) <strong>of</strong> Section 43:-<br />

(a) Functions, Procedure to be followed by <strong>Food</strong> Laboratories:-<br />

(1) On receipt <strong>of</strong> a package containing a sample for analysis from a <strong>Food</strong> <strong>Safety</strong> Officer<br />

or any other person the <strong>Food</strong> Analyst or an <strong>of</strong>ficer authorized by him shall compare<br />

the seals on the container <strong>and</strong> the outer cover with specimen impression received<br />

separately <strong>and</strong> shall note the conditions <strong>of</strong> the seals thereon.<br />

Provided that in case <strong>of</strong> sample <strong>of</strong> food received for analysis from a<br />

purchaser other than <strong>Food</strong> <strong>Safety</strong> Officer, it shall be accompanied with analysis<br />

fees prescribed under the regulations.<br />

(3) The <strong>Food</strong> Analyst shall cause to be analysed such samples <strong>of</strong> article <strong>of</strong> food /<br />

adulterant as may be sent to him by <strong>Food</strong> <strong>Safety</strong> Officer or by any other person<br />

under the Act.<br />

(4) The <strong>Food</strong> Analyst shall, within a period <strong>of</strong> fourteen days from the date <strong>of</strong> receipt <strong>of</strong><br />

any sample for analysis, send by registered post or by h<strong>and</strong> to the Designated<br />

Officer, four copies <strong>of</strong> report <strong>of</strong> the result <strong>of</strong> such analysis in Form I.<br />

Provided that in case, the sample can not be analysed within fourteen days<br />

from the date <strong>of</strong> receipt, the <strong>Food</strong> Analyst shall inform the Designated Officer <strong>and</strong><br />

Commissioner <strong>of</strong> <strong>Food</strong> <strong>Safety</strong> giving reasons <strong>and</strong> specifying time to be taken for<br />

analysis.<br />

Provided further, that the <strong>Food</strong> Analyst shall also forward a copy <strong>of</strong> such<br />

report, to the person who purchased the sample <strong>of</strong> an article <strong>of</strong> food for analysis<br />

under Section 40 <strong>of</strong> the Act under intimation to Designated Officer.<br />

(5) In case sample container received by the <strong>Food</strong> Analyst is found to be in broken<br />

condition or unfit for analysis he shall within a period <strong>of</strong> seven days from the date<br />

<strong>of</strong> receipt <strong>of</strong> such sample inform to the Designated Officer about the same <strong>and</strong> send<br />

requisition to him for sending second part <strong>of</strong> the sample.<br />

Provided that period <strong>of</strong> fourteen days shall be counted from the date <strong>of</strong> receipt<br />

<strong>of</strong> the second part <strong>of</strong> the sample.<br />

(b) Functions, Procedure to be followed by Referral <strong>Food</strong> Laboratories:-<br />
