Certificate Course on food safety conducted by University/Institutions based on<br />

the course curriculum developed by Department <strong>of</strong> <strong>Health</strong>:<br />

Provided that the name <strong>of</strong> such person with his consent, signature <strong>and</strong><br />

complete address is required to be submitted to the licensing authority.<br />

17. The Licensing <strong>Authority</strong> may either grant the licence or after giving the applicant an<br />

opportunity <strong>of</strong> been heard <strong>and</strong> for reasons to be recorded in writing refuse to grant a<br />

licence to any applicant. If he is satisfied that it is necessary to do in the interest <strong>of</strong><br />

Public <strong>Health</strong> <strong>and</strong> shall make available to the applicant a copy <strong>of</strong> the order.<br />

18. The enforcement powers available under the <strong>Food</strong> <strong>Safety</strong> <strong>and</strong> St<strong>and</strong>ards Act, 2006 <strong>and</strong><br />

associated legislation shall be: -<br />

Improvement Notices<br />

Emergency Prohibition Notices<br />

Prohibition Orders<br />

Prohibition <strong>of</strong> a person<br />

Formal Caution<br />

Prosecution<br />

In general terms, where contraventions are noted, the first step will be to advise the<br />

person responsible <strong>of</strong> the contravention <strong>and</strong> the steps needed to rectify the problem. The<br />

service <strong>of</strong> formal notices would not normally be considered to be the first option. There shall,<br />

however, be an exception to this general rule <strong>and</strong> that is where the contravention found is<br />

sufficiently serious that not to serve a notice straight away would leave a serious risk to the<br />

health <strong>of</strong> the public.<br />

It would be appropriate to serve an Improvement Notice where a contravention has<br />

been previously brought to the attention <strong>of</strong> food business but has not been actioned after a<br />

reasonable period <strong>of</strong> time. The licensing authority may cancel the licence/registration <strong>of</strong> <strong>Food</strong><br />

Business Operator.<br />

Emergency Prohibition Notices (EPN’s) will be served where the conditions <strong>of</strong> a<br />

premises/process are so poor that there is an imminent risk to health. If an imminent risk to<br />

health exists then an EPN would be served irrespective <strong>of</strong> the past history <strong>of</strong> the premises/<br />

proprietor. Where the situation is such that the service <strong>of</strong> an EPN is appropriate then the Local<br />

<strong>Authority</strong>/Designated Officers would look to revoke the licence/registration for that premises.<br />

Situations that could result in a prosecution being taken are: -<br />

<strong>Food</strong> poisoning outbreaks associated with the breakdown <strong>of</strong> basic food hygiene controls<br />

Serious food complaints where consumer safety is potentially affected<br />

Serious food safety contraventions<br />

Contraventions where there is a history <strong>of</strong> non-compliance with food safety<br />

requirements<br />

Non-compliance with an Improvement or other legal notice without reasonable excuse<br />

Obstruction <strong>of</strong> an <strong>of</strong>ficer<br />
