make <strong>the</strong> discharging <strong>of</strong> obligati<strong>on</strong>s more straight<strong>for</strong>ward and help keep<br />

administrative costs down.<br />

2.11 Where payments or <strong>the</strong> scale <strong>of</strong> <strong>the</strong> facilities are significant relative to <strong>the</strong><br />

size <strong>of</strong> <strong>the</strong> development and/or where <strong>the</strong> c<strong>on</strong>structi<strong>on</strong> <strong>of</strong> <strong>the</strong> development<br />

is to be phased over a significant period <strong>of</strong> time, it may be more<br />

appropriate to c<strong>on</strong>sider <strong>the</strong> phasing <strong>of</strong> obligati<strong>on</strong> payments or provisi<strong>on</strong>s.<br />

2.12 Where payments and provisi<strong>on</strong>s are phased over a period <strong>of</strong> time <strong>the</strong> LPA<br />

should make clear at what stages in <strong>the</strong> development process <strong>the</strong>se<br />

payments or in-kind obligati<strong>on</strong>s need to be delivered. For example, <strong>the</strong><br />

LPA and developer may agree that certain obligati<strong>on</strong>s should be paid or<br />

provided after a percentage or number <strong>of</strong> residential units have been<br />

c<strong>on</strong>structed. Any such index-linking should be made clear to <strong>the</strong> developer<br />

at <strong>the</strong> outset.<br />

2.13 When obligati<strong>on</strong>s are being phased over a significant period <strong>of</strong> time, to<br />

ensure that <strong>the</strong>ir value c<strong>on</strong>tinues to match <strong>the</strong> cost <strong>of</strong> provisi<strong>on</strong>, LPAs may<br />

wish to make <strong>use</strong> <strong>of</strong> relevant inflati<strong>on</strong>ary indices or cost guides/tables.<br />

Where indices are <strong>use</strong>d SPGs should set out how any financial payments<br />

would be index-linked over time and to what index and which types <strong>of</strong><br />

obligati<strong>on</strong>s <strong>the</strong>y refer. Specific account should be taken <strong>of</strong> <strong>the</strong> <strong>use</strong> <strong>of</strong><br />

interest accrued following receipt <strong>of</strong> financial payments, in order that it can<br />

be properly audited.<br />

2.14 The <strong>use</strong> <strong>of</strong> phased payments over a period <strong>of</strong> time will require a l<strong>on</strong>gerterm<br />

relati<strong>on</strong>ship between <strong>the</strong> LPA and developer or <strong>the</strong>ir successors in<br />

title. As such <strong>the</strong> LPA and developer will need to have m<strong>on</strong>itoring systems<br />

to alert parties to outstanding c<strong>on</strong>tributi<strong>on</strong>s. Where <strong>the</strong> LPA has made a<br />

commitment to providing a facility in part or in full from a developer’s<br />

financial c<strong>on</strong>tributi<strong>on</strong> it should make clear in <strong>the</strong> relevant S.<str<strong>on</strong>g>106</str<strong>on</strong>g> agreement<br />

when this work will be carried out and if it is not carried out to <strong>the</strong> specified<br />

timescale how <strong>the</strong> unspent funds will be returned to <strong>the</strong> developer and<br />

with what interest added, if appropriate.<br />

Maintenance payments<br />

2.15 Where LPAs wish to seek maintenance payments through <strong>planning</strong><br />

obligati<strong>on</strong>s to c<strong>on</strong>tribute towards <strong>the</strong> physical upkeep <strong>of</strong> infrastructure or<br />

facilities, <strong>the</strong>y should set out <strong>the</strong>ir overall policy <strong>for</strong> doing so clearly in <strong>the</strong>ir<br />

LDPs. Details about <strong>the</strong> level <strong>of</strong> maintenance payments should be set out<br />

in <strong>the</strong> relevant SPG. The method <strong>use</strong>d and level <strong>of</strong> maintenance<br />

payments <strong>the</strong> LPA is seeking should be dem<strong>on</strong>strated and justified, based<br />

<strong>on</strong> robust evidence <strong>of</strong> estimated costs and impacts. The LPA should also<br />

set out in policy <strong>the</strong> expected time period <strong>for</strong> such payments, as well as<br />

when <strong>the</strong>y will be due, <strong>for</strong> example, <strong>on</strong> a m<strong>on</strong>thly or yearly basis, at<br />
