7.3 Third parties can also make a valuable c<strong>on</strong>tributi<strong>on</strong> towards establishing<br />

<strong>the</strong> evidence base <strong>for</strong> in<strong>for</strong>ming obligati<strong>on</strong>s policies and practice.<br />

In<strong>for</strong>mati<strong>on</strong> provided by independent third parties can have <strong>the</strong> added<br />

advantage <strong>of</strong> being perceived as objective or independent to all<br />

stakeholders involved whe<strong>the</strong>r it be in<strong>for</strong>ming <strong>the</strong> development <strong>of</strong> <strong>planning</strong><br />

obligati<strong>on</strong>s policies or in<strong>for</strong>ming an individual <strong>planning</strong> decisi<strong>on</strong>.<br />

7.4 When independent third parties are <strong>use</strong>d <strong>for</strong> individual applicati<strong>on</strong>s, it<br />

should be made clear to all parties what <strong>the</strong>ir role is in relati<strong>on</strong> to <strong>the</strong><br />

applicati<strong>on</strong> and made clear that any decisi<strong>on</strong> <strong>on</strong> a <strong>planning</strong> applicati<strong>on</strong><br />

remains entirely with <strong>the</strong> LPA.<br />

7.5 Wherever possible parties should endeavour to come to an agreement <strong>on</strong><br />

<strong>planning</strong> obligati<strong>on</strong>s between <strong>the</strong>mselves. However, in excepti<strong>on</strong>al cases<br />

<strong>the</strong>re may be circumstances where <strong>the</strong> parties involved feel that <strong>the</strong> <strong>use</strong> <strong>of</strong><br />

an independent mediator could bring about resoluti<strong>on</strong> <strong>of</strong> <strong>the</strong> <strong>planning</strong><br />

obligati<strong>on</strong>s agreement and/or speed up <strong>the</strong> process towards agreeing<br />

obligati<strong>on</strong>s.<br />

7.6 For mediati<strong>on</strong> to be effective all parties need to be supportive <strong>of</strong> its <strong>use</strong><br />

and c<strong>on</strong>sider that <strong>the</strong>re is scope <strong>for</strong> it to be <strong>use</strong>ful in <strong>the</strong>ir particular case.<br />

They should also agree <strong>on</strong> <strong>the</strong> choice <strong>of</strong> mediator. The role <strong>of</strong> a mediator<br />

is to help identify <strong>the</strong> needs and c<strong>on</strong>cerns <strong>of</strong> all parties, clarify <strong>the</strong> issues<br />

and help explore with <strong>the</strong> parties soluti<strong>on</strong>s where agreement could be<br />

found. The role is largely to improve communicati<strong>on</strong> between <strong>the</strong> parties<br />

so that <strong>the</strong>y can work out a soluti<strong>on</strong> <strong>the</strong>mselves and to provide an<br />

impartial perspective and where possible facilitate an agreed outcome <strong>for</strong><br />

all. The mediator must be impartial, having no stake and not being<br />

affected by <strong>the</strong> outcome <strong>of</strong> <strong>the</strong> agreement and must have no direct<br />

c<strong>on</strong>necti<strong>on</strong> with any party.<br />

7.7 Where mediati<strong>on</strong> is to be <strong>use</strong>d it should be undertaken as early as<br />

possible in <strong>the</strong> process, preferably at <strong>the</strong> pre-applicati<strong>on</strong> stage. Mediati<strong>on</strong><br />

at this early stage can be <strong>use</strong>ful in dispersing any c<strong>on</strong>cerns <strong>the</strong> parties<br />

may have, to clarify <strong>the</strong> process and to avoid delaying <strong>the</strong> processing <strong>of</strong><br />

applicati<strong>on</strong>s.<br />
