FORMULAE AND STANDARD CHARGES<br />

Aims <strong>of</strong> this chapter:<br />

5.1 This chapter aims to provide an understanding <strong>of</strong> <strong>the</strong> purpose and <strong>use</strong> <strong>of</strong><br />

<strong>for</strong>mulae and standard charges in helping to calculate <strong>the</strong> level <strong>of</strong> <strong>planning</strong><br />

obligati<strong>on</strong>s and illustrates how some LPAs and developers are using <strong>the</strong>m<br />

to improve <strong>the</strong> delivery <strong>of</strong> obligati<strong>on</strong>s.<br />

Formulae and standard charges are quantitative indicati<strong>on</strong>s <strong>of</strong> <strong>the</strong> level <strong>of</strong> c<strong>on</strong>tributi<strong>on</strong><br />

likely to be sought by a local <strong>planning</strong> authority, through a <strong>planning</strong> obligati<strong>on</strong>, towards<br />

<strong>the</strong> provisi<strong>on</strong> <strong>of</strong> infrastructure that is necessitated by a new development. Local<br />

authorities are encouraged to employ <strong>for</strong>mulae and standard charges where appropriate,<br />

as part <strong>of</strong> <strong>the</strong>ir framework <strong>for</strong> negotiating and securing <strong>planning</strong> obligati<strong>on</strong>s. These can<br />

help speed up negotiati<strong>on</strong>s, and ensure predictability, by indicating <strong>the</strong> likely size and<br />

type <strong>of</strong> some c<strong>on</strong>tributi<strong>on</strong>s in advance. They can also promote transparency by making<br />

indicative figures public and assist in accountability in <strong>the</strong> spending <strong>of</strong> m<strong>on</strong>ies.<br />

It is <strong>for</strong> local <strong>planning</strong> authorities to decide which matters, if any, to address through<br />

standard charges and <strong>for</strong>mulae. However, where <strong>the</strong>y propose to rely <strong>on</strong> standard<br />

charges and <strong>for</strong>mulae local <strong>planning</strong> authorities should publish <strong>the</strong>ir levels in advance in<br />

a public document. The publicati<strong>on</strong> <strong>of</strong> in<strong>for</strong>mati<strong>on</strong> about standard charges should include<br />

in<strong>for</strong>mati<strong>on</strong> about any charges to be applied <strong>for</strong> preparing and completing <strong>the</strong> <strong>planning</strong><br />

obligati<strong>on</strong> agreement itself.<br />

Standard charges and <strong>for</strong>mulae applied to each development should reflect <strong>the</strong> actual<br />

impacts <strong>of</strong> <strong>the</strong> development or a proporti<strong>on</strong>ate c<strong>on</strong>tributi<strong>on</strong> to an af<strong>for</strong>dable housing<br />

element and should comply with <strong>the</strong> general tests in this Circular <strong>on</strong> <strong>the</strong> scope <strong>of</strong><br />

obligati<strong>on</strong>s. Their main purpose is to give greater certainty to developers and increase<br />

<strong>the</strong> speed <strong>of</strong> negotiati<strong>on</strong>s. Standard charges and <strong>for</strong>mulae should not be applied in<br />

blanket <strong>for</strong>m regardless <strong>of</strong> actual impacts, but <strong>the</strong>re needs to be a c<strong>on</strong>sistent approach<br />

to <strong>the</strong>ir applicati<strong>on</strong>. Whe<strong>the</strong>r local authorities seek a standard charge will depend up<strong>on</strong><br />

<strong>the</strong> nature <strong>of</strong> <strong>the</strong> proposed development.”<br />

What are <strong>for</strong>mulae and standard charges?<br />

5.2 Formulae and standard charges are a means <strong>of</strong> making quantitative<br />

estimates <strong>of</strong> <strong>the</strong> level <strong>of</strong> c<strong>on</strong>tributi<strong>on</strong>s that is likely to be sought <strong>for</strong> a<br />

particular type <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong> from an individual development,<br />

based <strong>on</strong> <strong>the</strong> LPA’s policies. They can be a transparent and c<strong>on</strong>sistent<br />

way <strong>of</strong> securing <strong>planning</strong> obligati<strong>on</strong>s across a range <strong>of</strong> development types<br />

and circumstances and help to increase accountability, speed, and<br />

certainty <strong>of</strong> <strong>the</strong> process. Formulae and standard charges can be <strong>use</strong>d to<br />
