IMPROVING SPEED, PREDICTABILITY,<br />

TRANSPARENCY AND ACCOUNTABILITY<br />

Aim <strong>of</strong> <strong>the</strong> chapter<br />

4.1 Planning obligati<strong>on</strong>s have been criticised <strong>for</strong> causing delays to <strong>the</strong><br />

<strong>planning</strong> system and being opaque and difficult to understand. The aim <strong>of</strong><br />

this chapter is to describe how LPAs and developers can improve <strong>the</strong><br />

process <strong>of</strong> negotiating <strong>planning</strong> obligati<strong>on</strong>s through <strong>the</strong> communicati<strong>on</strong> <strong>of</strong><br />

in<strong>for</strong>mati<strong>on</strong> and <strong>the</strong> effective <strong>use</strong> and management <strong>of</strong> teams dealing with<br />

<strong>planning</strong> obligati<strong>on</strong>s.<br />

It is important that <strong>the</strong> negotiati<strong>on</strong> <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong>s does not unnecessarily<br />

delay <strong>the</strong> <strong>planning</strong> process, <strong>the</strong>reby holding up development. It is <strong>the</strong>re<strong>for</strong>e<br />

essential that all parties proceed as quickly as possible towards <strong>the</strong> resoluti<strong>on</strong> <strong>of</strong><br />

obligati<strong>on</strong>s in parallel to <strong>planning</strong> applicati<strong>on</strong>s (including through pre-applicati<strong>on</strong><br />

discussi<strong>on</strong> where appropriate) and in a spirit <strong>of</strong> early warning and co-operati<strong>on</strong>,<br />

with deadlines and working practices agreed in advance as far as possible…<br />

Local authorities may wish to c<strong>on</strong>sider <strong>the</strong> development <strong>of</strong> codes <strong>of</strong> practice in<br />

negotiating <strong>planning</strong> obligati<strong>on</strong>s, so as to make clear <strong>the</strong> level <strong>of</strong> serve a<br />

developer can expect, and in order to increase public c<strong>on</strong>fidence in <strong>the</strong> <strong>planning</strong><br />

obligati<strong>on</strong>s system.<br />

Making <strong>use</strong> <strong>of</strong> pre-applicati<strong>on</strong> discussi<strong>on</strong>s<br />

4.2 For both applicants and LPAs it may be beneficial <strong>for</strong> obligati<strong>on</strong>s to be<br />

covered in pre-applicati<strong>on</strong> discussi<strong>on</strong>s where <strong>the</strong>se take place. Preapplicati<strong>on</strong><br />

discussi<strong>on</strong>s can be an early opportunity to clarify <strong>the</strong> LPA’s<br />

<strong>planning</strong> obligati<strong>on</strong>s policies in relati<strong>on</strong> to <strong>the</strong> proposed development and<br />

<strong>for</strong> <strong>the</strong> applicant to raise any questi<strong>on</strong>s, c<strong>on</strong>cerns or in<strong>for</strong>mati<strong>on</strong> that may<br />

be relevant to negotiating an agreement. Investing time and resources at<br />

<strong>the</strong> pre-applicati<strong>on</strong> stage can save time and resources in <strong>the</strong> medium and<br />

l<strong>on</strong>ger term and help speed up <strong>the</strong> delivery <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong>s.<br />

4.3 LPAs should make available sufficient in<strong>for</strong>mati<strong>on</strong> <strong>on</strong> <strong>the</strong>ir <strong>planning</strong><br />

obligati<strong>on</strong>s policies to enable applicants to understand clearly what type<br />

and level <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong>s <strong>the</strong> LPA is likely to seek from <strong>the</strong>m. At<br />

<strong>the</strong> same time applicants should ensure that <strong>the</strong>y in<strong>for</strong>m <strong>the</strong>mselves <strong>of</strong> <strong>the</strong><br />

LPA’s policies and how <strong>the</strong>y apply to <strong>the</strong>ir proposal. If this is <strong>the</strong> case, pre-<br />
