Structuring LPA capacity<br />

4.13 Some LPAs have chosen to provide a specialist S.<str<strong>on</strong>g>106</str<strong>on</strong>g> <strong>of</strong>ficer who deals<br />

solely with <strong>the</strong> development and applicati<strong>on</strong> <strong>of</strong> <strong>the</strong> LPA’s obligati<strong>on</strong>s<br />

policies. A specialist <strong>of</strong>ficer can bring <strong>the</strong>ir day-to-day experience <strong>of</strong><br />

negotiating and agreeing obligati<strong>on</strong>s to focus <strong>on</strong> <strong>the</strong> development <strong>of</strong><br />

different aspects <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong>s policy. A dedicated <strong>of</strong>ficer can<br />

also be more able to ensure that <strong>the</strong> LPA’s obligati<strong>on</strong>s policies are applied<br />

accurately and c<strong>on</strong>sistently across <strong>the</strong> full range <strong>of</strong> developments.<br />

4.14 In some cases LPAs have found <strong>the</strong> adopti<strong>on</strong> <strong>of</strong> a ‘One-Stop-Shop’<br />

approach to obligati<strong>on</strong>s helpful in improving delivery. A One-Stop-Shop<br />

approach can involve having a single point <strong>of</strong> c<strong>on</strong>tact resp<strong>on</strong>sible <strong>for</strong><br />

dealing with applicants and o<strong>the</strong>rs in regards to an LPA’s obligati<strong>on</strong>s<br />

policy and/or <strong>the</strong>ir applicati<strong>on</strong> to individual developments. This approach<br />

can make it easier <strong>for</strong> all <strong>the</strong> relevant stakeholders to have a single<br />

c<strong>on</strong>tact point at any stage <strong>for</strong> advice <strong>on</strong> general <strong>planning</strong> obligati<strong>on</strong>s policy<br />

and/or directly related to <strong>the</strong> proposal. The customer interface might be a<br />

single <strong>planning</strong> <strong>of</strong>ficer (a specialised S.<str<strong>on</strong>g>106</str<strong>on</strong>g> <strong>of</strong>ficer) or a cross-authority<br />

team, including legal services.<br />

The project management approach<br />

4.15 Some LPAs take a project management approach towards negotiating<br />

and agreeing <strong>planning</strong> obligati<strong>on</strong>s in order better to manage <strong>the</strong> process,<br />

and ensure that milest<strong>on</strong>es and deadlines <strong>for</strong> processing are achieved.<br />

This may involve drawing up a detailed project timetable at <strong>the</strong> outset <strong>of</strong><br />

each applicati<strong>on</strong>, and setting out <strong>the</strong> different activities that need to take<br />

place over <strong>the</strong> various stages by <strong>the</strong> parties and dates <strong>of</strong> <strong>the</strong> process to<br />

ensure <strong>the</strong> obligati<strong>on</strong>s are agreed <strong>on</strong> time. By way <strong>of</strong> example, <strong>the</strong> Vale<br />

<strong>of</strong> Glamorgan has published a Planning Obligati<strong>on</strong>s Service Standards<br />

which sets out <strong>the</strong> details <strong>of</strong> service provisi<strong>on</strong>. See Appendix 2.<br />

Clarifying <strong>the</strong> role <strong>of</strong> c<strong>on</strong>diti<strong>on</strong>s and obligati<strong>on</strong>s<br />

4.16 Both Circulars 35/95 <strong>on</strong> <strong>the</strong> <strong>use</strong> <strong>of</strong> c<strong>on</strong>diti<strong>on</strong>s and 13/97 <strong>on</strong> obligati<strong>on</strong>s set<br />

out that permissi<strong>on</strong> cannot be granted subject to a c<strong>on</strong>diti<strong>on</strong> that <strong>the</strong><br />

developer enters into a <strong>planning</strong> obligati<strong>on</strong>. Some LPAs have <strong>use</strong>d<br />

negatively worded (“Grampian”) <strong>planning</strong> c<strong>on</strong>diti<strong>on</strong>s stating that<br />
