Assessing <strong>the</strong> need <strong>for</strong>, and seeking third party independent<br />

advice<br />

7.13 When <strong>planning</strong> <strong>the</strong> revisi<strong>on</strong> and development <strong>of</strong> <strong>planning</strong> obligati<strong>on</strong>s<br />

policies LPAs should assess what skills and evidence <strong>the</strong>y need to in<strong>for</strong>m<br />

such policies. They should take into account available resources and<br />

identify any areas where <strong>the</strong>y may need <strong>the</strong> services <strong>of</strong> third parties.<br />

7.14 If LPAs see a need <strong>for</strong> third parties at an early stage <strong>the</strong>y should identify<br />

what organisati<strong>on</strong>s are appropriate and available to provide <strong>the</strong>se services<br />

and undertake <strong>the</strong> necessary tendering processes to procure <strong>the</strong>ir help. In<br />

additi<strong>on</strong> to this planned work, LPAs may also wish to establish a third<br />

party c<strong>on</strong>tact list or panel <strong>of</strong> experts that <strong>the</strong>y would be able to call up<strong>on</strong><br />

<strong>on</strong> a more ad hoc basis and sometimes at relatively short notice in order<br />

to procure <strong>the</strong>ir services <strong>for</strong> <strong>the</strong> process <strong>of</strong> policy development.<br />

7.15 For <strong>planning</strong> applicati<strong>on</strong>s <strong>the</strong> LPA may also c<strong>on</strong>sider establishing a<br />

c<strong>on</strong>tact list <strong>of</strong> third party experts and/or mediators that could be called <strong>on</strong><br />

at relatively short notice to help resolve obligati<strong>on</strong>s disputes and move<br />

applicati<strong>on</strong>s <strong>for</strong>ward.<br />

C<strong>on</strong>tractual issues and third parties<br />

7.16 When dealing with applicati<strong>on</strong>s, LPAs should aim to secure <strong>the</strong><br />

developers’ agreement <strong>on</strong> <strong>the</strong> <strong>use</strong> <strong>of</strong> independent expert advice, and<br />

agree <strong>the</strong> third party terms and c<strong>on</strong>diti<strong>on</strong>s in advance <strong>of</strong> such work<br />

commencing, including:<br />

• <strong>the</strong> outputs or deliverables to be produced;<br />

• dates <strong>for</strong> <strong>the</strong> submissi<strong>on</strong> <strong>of</strong> outputs or deliverables;<br />

• <strong>the</strong> total cost <strong>of</strong> employing <strong>the</strong>m; and<br />

• establishing how <strong>the</strong>ir services will be paid <strong>for</strong> and by whom.<br />

Good practice check list<br />

The LPA assess <strong>the</strong> skills and expertise <strong>the</strong>y need <strong>for</strong> revising and<br />

developing obligati<strong>on</strong>s policies and identify whe<strong>the</strong>r and where <strong>the</strong>re<br />

is a need <strong>for</strong> <strong>the</strong> services <strong>of</strong> independent third parties. 3<br />

The LPA identifies and draws up a list <strong>of</strong> third party organisati<strong>on</strong>s<br />

who are capable and likely to be available to provide planned<br />

services or services to be carried out <strong>on</strong> a more ad hoc basis or at<br />

short notice. 3<br />

The LPA procures and c<strong>on</strong>tracts third party organisati<strong>on</strong>s at an early<br />

stage to provide evidence towards <strong>the</strong> plan-making process, and<br />

ensure that <strong>the</strong> outputs <strong>of</strong> such work are <strong>of</strong> <strong>the</strong> required standard<br />
